superstar pitchman Jared. After Jared catapults the multi-million-dollar giant to the stratosphere, the police raid after a former co-worker of

Jared`s busted on child porn.

Bombshell tonight. As we go to air, police carting out computers, electronics from Subway Jared`s family home.

GRACE: And live, Mission Bend, caught on video, a home invasion by an armed intruder in broad daylight. We have the video. Can you identify the

perp?

GRACE: And live, Bonita Springs, Florida, mystery surrounding the murder of a gorgeous young doctor, a mother of two little girls, Dr. Teresa

Sievers found murdered in her upscale Florida home while Sievers`s husband and two little daughters out of town.

We identify the murder weapon. Will it lead to her killer? Tonight, as the gorgeous young mom, the doctor, laid to rest, the investigation into

her brutal murder ignites.

Good evening. I`m Nancy Grace. I want to thank you for being with us.

Bombshell tonight, live to Indianapolis, happening right now. Police investigators raid the home of Subway sandwich superstar pitchman Jared.

After Jared catapults the multi-million-dollar giant to the stratosphere, the police raid after a former co-worker busted on child porn.

As we go to air, police carting out computers, electronics, armfuls from Subway Jared`s family home.

Joining me right now there on the scene, Ryan Young, CNN correspondent.

First of all, everybody, you all remember Jared of Subway. Take a look.

Guy now has two kids and even more reason to pass on better eating habits to young people everywhere. This is my story. Ready to write

GRACE: He`s got more than a fast food eating problem, he`s got a police raid on his hands. That video from YouTube and Subway.com.

Back to Ryan Young joining us, CNN correspondent. Ryan, we know that police have seized electronics from Jared`s home, Subway Jared`s home.

What do we know? What have we observed? What has been taken out of that home?

RYAN YOUNG, CNN CORRESPONDENT: Well, Nancy, we know investigators arrived around 6:30 this morning, and they surprised the family when they

got there. But then all of a sudden, they started pulling computers. And we`ve all seen this before as a parade of officer after officer walk toward

a van with computers in tow. And that`s what they`ve been doing all day.

[20:05:02]We`ve actually been told they`ve even been using some specialized dogs to search around the home that actually can smell for

hidden electronics.

GRACE: That`s right, electronic dogs looking for electronics, computers, hard drives, you name it, that may have been hidden in Subway

Jared`s family home. You`re seeing a shot right now of the family home.

Who lives with him there, Ryan Young?

YOUNG: Well, we`re told his family lives there. He has a wife and two kids. They`ve been talking to neighbors throughout the area, those

who`ve been reporting on this.

We`ve seen it really explode over the Internet because, like you said, so many people know Jared. They know those commercials for years and years

and years, and now with an investigation going on, everyone wants to know what investigators are finding so far. They`ve stayed pretty tight-lipped

about this investigation.

GRACE: Take a look at what Ryan Young is describing. There`s the mansion belonging to Subway`s Jared. Jared, as we all know, had an eating

problem. He was a little overweight. He lost tens of dozens of pounds eating nothing but Subway, catapulting Subway sandwich shop to the

stratosphere. It`s become a food giant, largely thanks to Jared, and he still fronts for Subway.

OK, Ryan Young, you`re saying that one after the next after the next police investigator has come out of the home with electronics. Are you

talking about computers?

YOUNG: Yes, we`ve actually watched some video, and you`ve seen them with the large towers coming out of the property. Not sure what else.

Look like it may be some hard drives they`ve come out with.

Of course, as they start cataloging this investigation, as you know, Nancy, they can do deep dives into computers and see exactly what`s been on

the computer, even if it`s been erased. So you know that`s what those forensic investigators will be doing over the next few hours, to go through

the computers there.

The family has been taken away. They left a little earlier. And now we know Jared has left maybe about an hour-and-half ago from his home.

GRACE: Everybody, you`re seeing Jared of Subway right there. And the reason this is shocking to so many people -- let`s take look at the Jared

Subway sandwich commercial -- is because we`ve known Jared and his weight loss story, which was pretty miraculous, for years.

Everybody loves Jared. Why? Because he was an underdog. He had a problem. He overcame the problem. We saw him do it. Then he gets

married, he has children, he has a beautiful home and this great job with Subway sandwich shop.

Not so great right now because his home, his mansion, just raided. Now, this comes -- this police raid of Subway Jared`s home, following on

the heels of a child porn bust of a former co-worker of Jared at Jared`s foundation. Jared Foundation is the name of it. It`s a foundation, a

nonprofit that supposedly helps children. This was the director of Jared`s foundation.

Rita Cosby, what happened to Taylor? What happened to the Taylor case?

RITA COSBY, INVESTIGATIVE REPORTER: Yes, and it`s Russell Taylor (ph), who was the executive director of that foundation, the Jared

Foundation. And he was busted big-time two months ago -- a massive bust, Nancy. They found 500 videos and pictures in his home. He has been

charged with seven counts of child porn production, one count of possession, and all of these -- just, like, a plethora of text messages

where he talks not only about child porn, but bestiality and a whole bunch more.

GRACE: Put up Rita Cosby. We are talking about the then director of Subway Jared`s foundation. You said child porn and bestiality? Did I hear

you say that?

COSBY: Yes, it`s unbelievable, some of these messages.

GRACE: Yes. OK. Pause. Pause.

Ryan Young, CNN correspondent, was just telling us about Jared`s raid, the raid on Subway Jared`s home that he has been taken away from the home.

Now, Ryan Young, CNN correspondent, you just mentioned that specially trained dogs were brought in to Subway Jared`s home to sniff for

electronics. Is that what you said?

YOUNG: I sure did. And you know, didn`t even know those dogs were in the area, but they did bring them in to look for hidden electronics.

Subway has also released a statement during this raid, and I want to read it to you, Nancy. It says, "We are shocked about the news and believe

it is related to a prior investigation of a former Jared Foundation employee. We are very concerned and will be monitoring this situation

closely. We don`t have any more details at this point."

[20:10:05]So that`s coming from Subway...

GRACE: Wait! Wa-wa-wa-wait!

YOUNG: ... right now about Jared.

GRACE: Hold on! Ryan, you`re saying that Subway says that the raid on Jared`s home may be in relation to the search warrants on the director?

Is that what you`re saying, for child porn?

YOUNG: Right. So from that statement, it says, "We are shocked about the news and believe it is related to a prior investigation of a former

Jared Foundation employee." That`s coming from Subway.

GRACE: Well, who else, Ryan Young, at the Jared Foundation has been investigated by police? Do you know anybody else?

YOUNG: That`s something that we don`t know just yet. We don`t know just yet.

GRACE: OK, what about it, Rita Cosby? Do you know anybody else in the Jared Foundation that has been investigated by police, other than the

director or the foundation, who was just busted on child porn?

COSBY: Yes, we have not heard...

(CROSSTALK)

GRACE: ... images.

COSBY: Yes, we have not heard. We have just heard just the executive director at this point.

GRACE: OK. Out to K9 handler Tracy Sargent. Tracy, explain how dogs are trained to smell not drugs, not money, not explosives, but electronics.

TRACY SARGENT, K9 HANDLER: Yes, Nancy. These particular dogs, just like the other dogs you mentioned, are imprinted on a specific scent. In

this case, it`s an electronic type of scent. Whether it`s a computer or hard drive or a CD or some type of electronics that the officers are

looking for, the dogs are imprinted for that particular gent.

GRACE: OK, Tracy, I`m not quite sure that they`re getting it. I`m saying that, clearly, pharmaceuticals, drugs, crack, heroin, you name it,

they have a certain smell, all right? I get it. Accelerants, like a fire dog -- accelerants, gasoline have a certain smell. When you think of

bombs, explosives, they have a certain unique smell like gunpowder, for instance.

But what smell do electronics emit?

SARGENT: Yes. The electronics themselves, you look at the metal, the plastic, the wires, all of the different parts of an electronic piece of

equipment does have a unique smell. We may not be able to detect it, but the dogs themselves can.

GRACE: To Ben Levitan, joining me right now, telecommunications expert out of Raleigh. Ben...

OK, Ryan Young has just told us Subway has issued a statement. Ryan, are they already taking Jared down off the Web site?

YOUNG: Well, we`ve been looking at the Web site for the last hours or so, and I can tell you right now he`s still up there. The parts of the

foundation are still up there. In fact, there`s even a children`s game with Jared up there.

GRACE: Is that -- OK.

YOUNG: So right now, it`s still up there.

GRACE: So they`re still standing by him, is that true, Matt Zarrell?

MATT ZARRELL, NANCY GRACE PRODUCER (via telephone): From what, we can see, it appears that a lot of Jared`s Foundation information has been taken

down from the Web site. There`s some stuff that`s still up, but a lot has been taken away.

GRACE: Back to you, Ben Levitan. It looks like Subway sandwiches is backing off Jared. You know, there he is in the House of Representatives,

for Pete`s sake, probably talking about childhood obesity. This guy lost - - from 425 pounds, he lost 245 pounds. America rallied around him. He`s the poster boy for everybody to believe, if he can do it, if Jared can do

it, I can do it, too.

Well, he had a police raid in his house that`s going on right now. Ben Levitan, telecommunications expert -- so the director of his foundation

busted on child porn, 500 images. They`re now taking electronics out of Jared`s mansion that he shares with his wife and children.

What can they find from hard drives, from computers?

BEN LEVITAN, TELECOMMUNICATIONS EXPERT (via telephone): Well, Nancy, first thing is, how did they justify the raid on Jared`s house? It must

have been in the last two months, they found something on the director`s computer forensically that pointed them to Jared`s house.

Now, that could be e-mails, text messages or possibly even the photographs show -- photographs will show you the GPS location where that

photograph was taken. Were some of those photographs taken at or near Jared`s house? That`s what justified the raid.

GRACE: You all know Jared. Take a listen.

GRACE: And now live to Bonita Springs, Florida. We are getting the latest in the mystery surrounding the murder of a gorgeous young doctor, a

mother of two little girls, Dr. Teresa Sievers, Sievers found murdered in her upscale Florida home while Sievers`s husband and two little daughters

were out of town.

We identified the murder weapon. Will that lead to her killer? Tonight, as the gorgeous young mother and doctor laid to rest, the

investigation into her brutal murder ignites.

UNIDENTIFIED FEMALE: Sources close to the investigation tell (INAUDIBLE) news Sievers was killed by a hammer.

UNIDENTIFIED MALE: Investigators can be seen focusing on a door with what appears to be a broken handle.

UNIDENTIFIED FEMALE: Crime scene techs pay special attention to the family`s van, dusted for prints and then towed away from the scene.

Fingerprint dust can also be seen on the fence surrounding the home.

GRACE: This is the latest. This is what we know. Joining me, Bob Alexander, news director there at 92.5.

[20:20:04]Bob, thank you for being with us. We understand that police have now taken a special interest in the family van. It was heavily

fingerprinted at the scene. It was taken away, and it is still being processed, now days on end. They`re not returning it.

Interesting. Did she bring that van home from the airport? Why is it of special interest now? What have they learned? Why are they keeping it,

if she drove that van home from the airport? Question -- was someone in the van? Was someone in the van when she got into it at the airport? Was

someone following her?

Also, we know that special interest has been paid to a specific portion of a door and a side gate. Did the perpetrator get out of the van,

go in the front door and out the side gate? And if so, how did he avoid setting off the home alarm?

As Teresa Sievers`s body just cremated, her little girl speaks at her memorial, Bob Alexander, what can you tell us about the family van?

BOB ALEXANDER, 92.5 (via telephone): Well, the one thing we know for sure, Nancy, crime scene technicians were seen taking fingerprints off that

van, using the fingerprint dust on Friday before they took that van away. So they were paying significant attention to that van.

Where that goes from here, we`re not quite sure, but we do know they certainly are paying a lot of attention to it at this point.

GRACE: And that van still not returned. That means to me -- to Joseph Scott Morgan, professor of forensics -- there`s a special interest

in that van that suggests to me that there are fingerprints in there that they can not readily match up to anyone. What do you think, Joseph?

JOSEPH SCOTT MORGAN, FORENSICS PROFESSOR (via telephone): Well, I think that they want to get that van into a controlled environment where

it`s not going to be cross-contaminated in any way, Nancy, so that if there are latent prints there, they`re not going to be compromised in any way.

I think there`s one more issue we need to be completely aware of in this particular case, that the driver behind that -- behind this. And this

is touch DNA, where in this controlled environment, if someone even now -- we have the technology, if somebody just lightly touches an area, they can

transfer DNA in that particular area, we can actually code that DNA with a very small sample.

So all of this is coming into play. And given the nature of this case -- this is a very violent and very intimate case, so we have to think that

there was contact between the perpetrator and the victim, and maybe inside this van, maybe on the door, as well, where they`ll be looking for tool

marks, as well.

GRACE: Tool marks, fingerprints -- all of this we are just learning. You`re seeing Teresa Sievers herself on a YouTube channel.

To Dr. William Morrone joining us, forensic pathologist and renowned medical examiner and toxicologist. She was cremated. Now, that means

there is never any possibility of going back and getting any additional evidence from they are body whatsoever. Dr. Morrone, you know that this

was a violent crime. We know that the murder weapon was a hammer. Analyze.

DR. WILLIAM MORRONE, FORENSIC PATHOLOGIST, MEDICAL EXAMINER: Here`s what I would say. The chances of violence from a stranger are dominant

(ph). The chances of violence from somebody she knew, possibly a family member, are secondary. But once you cremate a body, you lose those

resources.

It always makes me suspicious when somebody is murdered and cremated. If you inter them, you can always cremate them at a later date,

consecrated, sacred, however, the church will follow it.

But the violence which also may be part of the van -- when you have a hammer, the source of the violence and the target of the violence is

usually the head. This will always retain imprints, bruises and damage to be seen at a later date. Once you cremate it, that`s all off the table.

I`m very suspicious, and that`s very disturbing.

GRACE: Well -- with me, Dr. William Morrone, forensic pathologist. I`m concerned about the cremation. Typically, who in the family makes that

decision?

MORRONE: The next of kin, the husband. Now, he should clear it with parents, but it always makes me suspicious that if there was something

going on and he was gone, it`s -- you lose everything. You lose everything in cremation.

[20:25:00]You hope that the pathological samples that are retained -- you hope that the forensic evidence from autopsy is enough. But you can

always -- now, they do take samples. There are samples. There are radiographs. There are CTs. There are imaging, but sometimes, that`s not

enough.

UNIDENTIFIED MALE: A neighborhood on edge after this doctor and mother of two was found dead inside her Bonita Springs home.

UNIDENTIFIED FEMALE: I`m very scared for my safety.

UNIDENTIFIED MALE: ... who believes she may have heard the murder as it happened.

UNIDENTIFIED FEMALE: Thinking that someone`s going to come in and kill me.

DR. TERESA SIEVERS, PHYSICIAN: To understand it, we as doctors are treating this physical body that we can touch.

Bob Alexander, news director, 92.5, I understand the sheriff has made his own observations?

ALEXANDER: Yes, Nancy. This afternoon, Lee County sheriff Mike Scott made his first official statement on the investigation since it began. He

said, Within reason, based on the evidence we have to this point and working it exhaustively, I`m fairly comfortable saying it`s not a random

arbitrary situation, which is a word that I think the entire community has been waiting to hear.

Did Lee County law enforcement believe this was a random act, or could it be something with connectivity? Sheriff Scott seemed to indicate that,

indeed, it was not a random act, according to the information they have to this point.

GRACE: Unleash the lawyers. Alex Sanchez, veteran defense lawyer, New York. Troy Slaten, defense attorney out of L.A. And also with me,

renowned pathologist Dr. William Morrone. Okay, first to you, Sanchez, the husband in this case, who was her office manager, is not a suspect. He has

not been named a person of interest. He was out of town in Connecticut at the time she was murdered, with their two young little girls, one of whom

spoke at a four-hour memorial. Alex Sanchez, what does the sheriff mean by it`s not random?

SANCHEZ: I think what he means that the victim in this crime knew who the perpetrator was. And I think he believes this was a targeted attack,

as opposed to some random person walking down the street breaking into the house and committing murder. And the fact that one of the neighbors heard

an argument in the house or heard a man yelling at a woman, and the fact that they`re taking the car away, that`s very suggestive that the police

believe she knew who the person was, and that person came into the house and committed murder.

GRACE: And Dr. William Morrone with us, along with Troy Slaten and Alex Sanchez, to Dr. William Morrone, the sheriff has actually come out and

said this isn`t random. OK? Now, the way I took it, Dr. Morrone, and you and I have seen so many of these cases, when it`s random, you`re not

getting in an argument with the person, they`re coming in to steal your stuff or rape you, and they take all your electronics or your money, boom,

you`re dead, they`re gone. But here, whoever it was actually engaged in an argument, yelling at her.

MORRONE: Here`s what I get from that. Two things, for love or money. Those are the two things that drive people to commit heinous crimes -- love

or money. Which one was it? It could have been a business deal gone bad. It could have been --

GRACE: A business deal? What business deal? She worked at a shelter for unwed mothers. I guess they still call it that. What business deal?

(CROSSTALK)

MORRONE: She may have had nefarious partners. She might be completely innocent, but somebody might have come to her for love or money.

Those are the two things that drive crime.

GRACE: Troy Slaten?

SLATEN: You know, it`s all speculation at this point. The sheriff saying that it`s not a random act could just be an attempt to lure the real

perpetrator of the crime out of the woodwork or lull them into a sense of security.

GRACE: So you`re saying the sheriff coming out point blank and saying this is not random, the killer knew her --

SLATEN: It could be a trick.

GRACE: You`re saying it`s a trick? That he`s pretending?

SLATEN: It could be.

GRACE: The sheriff is making that up?

SLATEN: Police are allowed to lie.

GRACE: All right, Troy Slaten, interesting theory. Back to Bob Alexander, news director, 92.5. Special focus on the family vehicle. It`s

been taken away, has not been returned. They`re getting something from it. They`re not just keeping it for the fun of it. The back door has been

looked at, also the front door. Many speculating the front door was used as an entry and the back door as an exit. We also know that the husband,

according to neighbors, broke down in tears in the middle of the street and all the neighbors observed this. What, if anything, do we know about the

state of the marriage?

ALEXANDER: Well, from everything that we know, Nancy, this was apparently a very stable situation, because they worked together at the

clinic that she established several years ago here in the Southwest Florida area. They were partners. They were seen together socially on a constant

basis together, and with the two daughters out and about, so there has been nothing made to suggest at this point that there were any issues going on

as far as the public word is concerned.

GRACE: In fact, she took a flight home early on a Sunday night and left her family, her husband and two children in Connecticut at a family

get-together with her family. Here is Dr. Siever in her own words.

SIEVER: I didn`t come from the perfect family when I was a kid, although I never had a life anything like these girls go through. I do

like them to know you don`t just wake up one day, become a doctor and have a business and have a perfect life. It requires work. So hopefully I

instill in them hope and a belief they can be anything they want to be.

her medication, and I don`t know what`s happened to her.

GRACE: Can you even imagine going into your child`s bedroom, your baby, your infant girl`s bedroom, and she`s gone? That`s exactly what

parents say happened in this case. Look at baby Ember Graham, just six months old. This video is from Facebook. Take a look at this beautiful

child. Apparently taken out of her own crib in her own room in her own home. Steve Gibson, news director KQMS, how did it all start? Let`s just

start at what time did she go missing?

STEVE GIBSON, KQMS: She was reported missing Thursday morning at 5:30.

GRACE: Thursday morning at 5:30. And, Steve, what, if anything, woke the father up?

GIBSON: I don`t know what woke the father up. He said he woke up at about 5:00 a.m. He had put the baby to bed the previous night.

GRACE: So he puts the baby to bed at what time, Steve Gibson?

GIBSON: He said 10:30 Wednesday night. He put her in her crib and she was asleep.

GRACE: Let me understand this. Steve Gibson joining us from there at the scene in Reading, news director, KQMS. Steve, he puts a six-month-old

to bed at 10:30 at night, and he doesn`t hear a peep from her until 5:30 the next morning and doesn`t go in to check on her? Nothing? She must

sleep through the night.

GIBSON: Apparently so. That`s his story, yes.

GRACE: All right, so Steve Gibson, we`re showing you pictures right now of baby Ember. There is a tip line and a $10,000 reward. There she is

with mommy right there, 530-245-6135. 530-245-6135. Now, here`s the kicker, baby Ember has had a seizure disorder, a seizure disorder. To Rita

Cosby, investigative journalist, WABC host, what more do we know about baby Ember, Rita?

RITA COSBY, WABC: We know she is six months old. Not only does she have a seizure disorder, she takes medicine, she needs medicine.

GRACE: To Mark Klaas, president and founder of KlaasKids Foundation. Mark, the baby was spotted around 9:00 the night before, we`re not just

taking the parents` word for it. The dad had to go to the 7-Eleven, we even know what he got, a Pepsi and something else. They saw the baby alive

and well with the dad. So everything he has said so far lines up. Goes straight back home, and he says he puts the baby to bed around 10:00,

10:30. So what do we do now?

KLAAS: Well, Nancy, we have a huge window of opportunity here. We have about a seven-hour window. So anything could have happened to the

child. And I think law enforcement is handling this very well. They`ve had search teams out from the beginning. They continue to look for the

baby. They`re focusing in on a variety of possibilities, but they have said that they don`t believe that the baby was kidnapped.

GRACE: They`re saying they don`t believe the baby was kidnapped. Take a look at baby Ember. There is a $10,000 reward for her recovery.

The home is very, very small, and I`m trying to determine, Steve Gibson, KQMS, how many windows and doors does the home have?

GIBSON: It probably has maybe no more than a dozen, but it`s a very rural area, and it`s very quiet at night there.

GRACE: So it`s a very small dwelling. The point I`m making to Patricia Saunders, clinical psychologist joining us, you`re a forensic

veteran, Patricia. If dad is asleep in a very small dwelling, and there are family dogs, I`m just wondering if he heard anything, if we`ve even got

a timeline based on something he heard?

SAUNDERS: This child is at risk, and that`s the most important thing, Nancy. She has got a severe seizure disorder. Without her medication, she

could die.

GRACE: Live, Mission Bend, caught on video. A home invasion by an armed intruder in broad daylight. We have the video, can you identify the

perpetrator?

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: It`s terrifying. You never want to think that, you know, you step outside and something like this is going to happen in

broad daylight.

UNIDENTIFIED FEMALE: This woman says her boyfriend was outside their Mission Bend home when the man you see at the top of the screen approaches

him, pulls out a gun, and forces him to the ground.

(END VIDEO CLIP)

GRACE: Okay, let`s see the video from the beginning. This guy, the guy in the white t-shirt out in front of his yard, he`s there in front of

his home in his yard, his girlfriend and he share the home, take a look at this. Out of the blue, broad daylight. This guy comes up with a gun,

pulls it on him, forces him to the ground and tries to force him inside the home. Can you identify this perpetrator? He is still at large. He is

acting in broad daylight! 5`8, 180 to 200 pounds, fade haircut, black shirt, blue jeans, white sneakers. Comes up to a guy in his front yard,

shows no qualms whatsoever about dragging him off. The guy fights back. Fights for his life and is ultimately shocked. Matt Zarrell, what do we

know?

ZARRELL: We know from the video you can see the guy is working on his truck in the driveway. He`s actually about to take a picture when this man

walks up with a gun from the sidewalk, points the gun at him, forces him to the ground, and then you see this attack play out. The suspect actually

threatened the victim saying I`m going to kill you inside the house. And you can see as the suspect tries to drag the victim into the house, he

tries to grab his keys and unlock the door and get inside the house, and you can see the victim is terrified, because the threat is as soon as they

go in the house, the suspect is going to kill him.

GRACE: Look at this. Cars going by in the video. Nobody seems to notice what`s going on. About 40, 50 feet away, this guy is getting

dragged in his home in broad daylight. Off his front yard, for Pete`s sake. This is a nice residential area. The guy fights for his life and

he`s ultimately shot.

To Dr. William Morrone joining us, forensic pathology, also with us Alex Sanchez and Troy Slaten. The guy is shot near the femoral artery.

What`s that?

MORRONE: The femoral artery is the major artery that takes all the blood and puts it down the leg. And as it branches off, it becomes smaller

and the name changes, but the femoral artery, left and right, both come up and they merge into the aorta. The largest artery in the body. And when

it goes past the hip socket, it goes right past it, and that supplies all the blood to the lower leg. If it comes close, you could bleed to death.

GRACE: And you bleed out pretty fast, too. This guy actually shot in an attempt to save his own life. Alex Sanchez, Troy Slaten, how many times

have defense attorneys argued in court there`s not a video, we don`t know what really happened? Well, this time we do. Alex Sanchez, we know

exactly what happened.

SANCHEZ: Right. And the defense in this case is probably going to be that the videotape is not very clear, that the person they arrested does

not match the image on the videotape, and that there is no other evidence linking the alleged suspect, if he`s ever arrested, to this crime, such as

a gun or such as a confession or such as an eyewitness. And that is likely to be the defense in the case.

GRACE: So even though we have got him on video, you`re saying the jury can`t believe its lying eyes, they can`t compare him once the perp is

caught?

SANCHEZ: They could. But of course the defense attorney will say it`s not quite that clear. You`re not getting the best view. It`s a very

short video. These are the arguments that you would expect the defense attorneys to make. Whether it would be successful or not, remains to be

seen.

GRACE: You`re not getting the best view? What would be the best view, Alex Sanchez? What`s the best view? A glamour shot?

SANCHEZ: The best view would be a straight shot where there is no movement, in which you can see all the little unique features of the

person.

GRACE: Let`s take this video from the top. Let`s take it from -- look at this. Somebody knows this guy. Somebody knows him. In broad

daylight. I guarantee you that victim is going to be able to identify this perp. You get a gun shoved in your face, you get shot by your femoral

artery, yes, he`s going to remember him.

Now, what about enhancing it? Enhancing this? Take a look, tip line, 281-342-tips. 281-342-tips. Okay, Troy Slaten, give me your defense.

SLATEN: This isn`t CSI, Nancy. There`s no fancy computer image that can suddenly zoom in, enhance it, and make it a perfectly clear picture.

And we also don`t have audio, and we don`t know what this was all about. We don`t know if this was a random act of violence or whether there was

some sort of history between these two people that the victim may not even be disclosing to us.

GRACE: Troy Slaten, are you suggesting that if these two had known each other, which there`s not even a scintilla of evidence that they did,

you`re just like pulling that out --

SLATEN: There`s no scintilla of evidence that they didn`t.

GRACE: And so you`re going to argue that. It`s not as bad to be shot by somebody you know?

SLATEN: We don`t know the whole story. A video --

GRACE: I just saw him get shot!

SLATEN: It doesn`t tell the whole story, though. We don`t know what he was doing. We don`t know why he was there.

GRACE: Put him up. What more do you want to know?

SLATEN: I want to know --

GRACE: What more do you want to know? He pulls the gun out and he shoots him in broad daylight in his front yard! What? What could possibly

be relevant to that?

SLATEN: Why he was there.

GRACE: To rob him?

SLATEN: We don`t know that, Nancy. We don`t know -- maybe there was some sort of argument. Maybe there was some sort of --

GRACE: Liz, please rerack this. Rerack it all the way to the beginning. The guy is standing there.

SLATEN: There are a million things that could have happened.

GRACE: He walks from about 20 feet up. Nobody is saying anything except put your hands up, I`m going to shoot you dead once I get you into

the house. I`m pretty sure that`s all that was said. Is that right, Matt Zarrell?

SLATEN: There is no audio.

ZARRELL: That`s correct. He threatened to kill him once they got inside the house.
