Judge Designates Lawrence Taylor Lowest Sex Offender Status

NANCY GRACE, HOST: Breaking news tonight. A "Dancing With the Stars" phenom stuns fans with moves on the dance floor, but police say he had a 10th-grade girl delivered to his hotel room for sex like she`s a pizza, the girl beaten with a black eye when she refuses, then the star sexually attacks the girl. After emergency texts to her uncle begging for help, police close in on the dancing star in his hotel room to rescue the girl. The TV star confesses.

Bombshell tonight. Tell me, can it get any easier to be a sex predator in America? After the trial judge bans the teen rape victim from speaking in court, the multi-millionaire "Dancing With the Stars" phenom TV superstar gets straight probation. And in the last hours, trial judge William Kelly makes a joke out of the justice system, ordering not just straight probation, but the judge`s order doesn`t even stop Taylor from having liquor, being in bars, being in strip clubs, having weapons, guns, being around young children, including teenage girls. And he only has to report to police once every three years. Hello? No restrictions whatsoever!

This after the statutory rape of a 10th-grade girl who was beaten and drugged into sex with a 52-year-old man who, quote, "wanted to order up a skinny Spanish girl," that same man, "Dancing With the Stars" Lawrence Taylor, who admits to paying for six hookers a day, spending thousands on cocaine. But catch this. The judge says he doesn`t think Taylor will offend again. Taylor`s defense attorney already talking about lucrative sponsorship deals for Taylor. Taylor didn`t even bother to show up in court today. All over America tonight, sex offenders laughing into their fists (ph) at Lady Justice! Thanks, judge!

UNIDENTIFIED FEMALE: It is very unfair that Mr. Taylor is only receiving probation for his crime.

UNIDENTIFIED FEMALE: She had a swollen eye.

UNIDENTIFIED FEMALE: Lawrence Taylor given level one sex offender status after his attorney argued for the lowest level.

GRACE: He admits he had sex with her!

UNIDENTIFIED MALE: The investigation indicates that Mr. Taylor engaged in sexual intercourse with a child less than 17.

UNIDENTIFIED MALE: My client did not have sex with anybody. No. Period. Amen.

UNIDENTIFIED FEMALE: As part of the plea deal, Lawrence Taylor avoids jail time but gets six years probation.

UNIDENTIFIED FEMALE: She was coerced to go there. She did not want to go.

UNIDENTIFIED MALE: There`s no violence. There`s no force. There`s no threats. There`s no weapons.

LYNETTE TAYLOR, LAWRENCE TAYLOR`S WIFE: He didn`t rape anyone. He didn`t have sex with anyone.

GRACE: Lady, he pled guilty!

LYNETTE TAYLOR: The girl was in the room because she let herself inside of the room.

GRACE: And tonight, live, Oklahoma, 14-year-old little girl in danger, snatched by a convicted sex offender. The search expands after grainy surveillance video surfaces of the girl and the sex predator at a Wal-Mart and a Walgreen`s.

UNIDENTIFIED MALE: Breaking news. A 35-year-old level three lifetime convicted sex offender is on the run. His 14-year-old niece is allegedly with him.

UNIDENTIFIED FEMALE: New video today of a fugitive and his 14-year- old niece, who are still on the run. It was taken from a Wal-Mart.

UNIDENTIFIED MALE: This guy is a criminal, very dangerous. He`s in the company of a 14-year-old little girl.

UNIDENTIFIED MALE: We have a set of footprints that were westbound from the...

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. "Dancing With the Stars" phenom Lawrence Taylor has a pimp deliver a 10th-grade girl to his hotel room for sex like she`s a pizza, then sexually attacks the girl. In the last hours, trial judge William Kelly makes a joke out of the justice system, not ordering just straight probation, but the judge`s order doesn`t stop Taylor from having liquor, being in bars, strip clubs, having weapons, being around young children, and he only has to the report to police once every three years. GRACE: Walks free with no jail time in a sweetheart plea deal.

UNIDENTIFIED FEMALE: He`s gotten away scot-free with everything.

UNIDENTIFIED FEMALE: She was a terrified young girl.

GRACE: She has a huge black eye. She`s been bleeding from her mouth.

LAWRENCE TAYLOR, NFL HALL OF FAMER: You know, I`ve been around kids and people all my life. Sometimes I make mistakes, and I may go out there, but I didn`t pick her up in no daggone playground. I`m not a violent person. I don`t get down like that. She may have gotten beaten -- got beaten later because she didn`t come in that room like that.

GRACE: Does he just say as a defense, I didn`t snatch her off the school bus? Oh, is it better that you ordered the 10th-grade for sex through a pimp? That makes it OK?

But right now, what about the judge, the trial judge, William Kelly that in his order says, I`ll leave that all up to probation. He doesn`t even bother to say no booze, no strip clubs, no porn, no being around other children, not your own, not your blood relatives. Nothing. Doesn`t say you can`t have a gun. Nothing! This guy walking scot-free, no restrictions ordered by this judge whatsoever! Everybody, remember Lawrence Taylor? You`re seeing him right here on ABC`s "Dancing With the Stars." All across America tonight, sex offenders are laughing into their fists over what Judge Kelly did today!

We are taking your calls live. Straight to Jean Casarez, legal correspondent, "In Session." How easy can it get to be a child sex predator in America, Jean?

JEAN CASAREZ, "IN SESSION": Well, the defense attorney argued he is not a threat to the community, there is no chance that he will reoffend. And the judge also said in his order, You know what? I agree with that. I don`t think he will reoffend. So he is a registered sex offender, but this NFL superstar, "Dancing With the Stars" dancer, is also the lowest level sex offender with really nothing to have to do.

GRACE: You know what, Jean? I`m glad you reminded me of that because in that jurisdiction, there`s level one, two and three of sex offender. This judge, discretionary to the judge, decided that he was the least serious sex offender possible. What do you think he is, an NFL fan or a "Dancing With the Stars" fan?

CASAREZ: Well, I think that he -- he says that there`s no risk of reoffending. And so because of that, he can be around underage children. He has an underage daughter. He can drink. He can go on the Internet, surf whatever he wants. He can hold a weapon. And so there`s really nothing except every three years, he has to go over to the police department.

GRACE: And not only that, practically on the courthouse steps, the defense attorney begins talking about lucrative sponsorship deals for his Taylor -- for his client, Lawrence Taylor. Taylor doesn`t even bother to show up in court today.

UNIDENTIFIED FEMALE: Hi, Miss Nancy. Love your show!

GRACE: Thank you for calling in. What`s your question, dear?

UNIDENTIFIED FEMALE: Well, I don`t agree with what he has done, but this has been going on in the NFL and all other sports, you know, throughout the ages, since the `60s probably. You know, he -- LT is not the problem here. The judges are.

GRACE: Well, I can tell you this much. I`m lumping them all together. I think LT, Lawrence Taylor, committed statutory rape, number one, so he is the problem. And a judge going easy on him and accepting that plea deal, that`s a problem. And then not ordering any restrictions on him from the bench, that`s a problem. Leaving it up to whatever probation may do in the home state or in another state, which is Florida, pushing it off on somebody else to take care of it, that`s a problem. We got a lot of problems! Lady Justice has a lot of problems tonight with what`s going down in the Lawrence Taylor case.

Out to Alexis Tereszcuk, reporter with Radaronline.com. What more can you tell me, Alexis?

ALEXIS TERESZCUK, RADARONLINE.COM: Well, you`re exactly right. Not only is his probation just about as easy as it can get -- most people have to be in at 11:00 PM. Lawrence Taylor gets to stay out until 1:00 AM. He`s allowed to go to schools. He`s allowed to go to playgrounds. You know how he said he didn`t pick this girl up in a playground? Well, his next victim he could pick up in a playground because he`s not barred from going to them.

GRACE: He is not barred from being around underage children not his own, he`s not barred from being in bars, weapons, you name it. He can do whatever he wants to, essentially. We are taking your calls.

LAWRENCE TAYLOR: I`ve been around kids and people all my life, you know? I`m not the cause of prostitution. And sometimes I make mistakes and I may go out there. But I didn`t pick her up in no daggone playground. She wasn`t hiding behind the school bus or getting off a school bus. This is a working girl that came to my -- came to my room. And I don`t know what her age was. I asked her age. She told me she was 19.

SHEPARD SMITH, FOX NEWS CHANNEL ANCHOR: How did it happen that you solicited her services through someone? Tell me about how that went down.

LAWRENCE TAYLOR: Well, it happens sometimes. You know...

SMITH: Tell me how it happened that day.

LAWRENCE TAYLOR: OK. Well, you know, I`ve been on -- I was on the -- been on the road for about 10, 11 days and stuff. And I came into town, and actually, I made a phone call to a friend of mine that -- and he made a phone call and...

SMITH: What did you say to the friend?

LAWRENCE TAYLOR: Have a nice day. I don`t know.

LYNETTE TAYLOR, LAWRENCE TAYLOR`S WIFE: The truth -- he -- every -- he -- trust me, I know everything as if I were inside of that room, OK, everything, every detail, every single word, everything that happened, everything that went on. I know everything, that he didn`t rape anyone. He didn`t have sex with anyone. He didn`t call a pimp. He did not go cruising down, you know, (INAUDIBLE) where prostitutes hang out. He did not do any of those things. The girl was in the room because she let herself inside of the room.

GRACE: That was Lawrence Taylor on Fox News just moments after he walks with a sweetheart plea deal. I`m surprised Shep Smith didn`t leap across the table and give him a little finger necklace. Then you saw his wife -- this is after -- this is -- her husband pleads guilty to sex with a minor. And then she is staying it didn`t happen. In fact, it`s the little girl`s fault. She went up in his room. It`s the child, the 10th-grade girl`s fault, says the wife.

UNIDENTIFIED FEMALE: Hello, Nancy. How are you?

GRACE: I`m good, dear. What`s your question?

UNIDENTIFIED FEMALE: I love your show.

GRACE: Thank you.

UNIDENTIFIED FEMALE: Two quick questions. Why did not the girl get a chance to speak in the courtroom?

GRACE: OK. Hold. Hold Deborah. Don`t let Deborah in Arizona go. Joining me right now exclusively tonight, Gloria Allred, the attorney for the girl victim. She`s joining us out of LA. And also with us tonight, Kathy, who is the sister of the rape victim in the Lawrence Taylor case.

To Gloria Allred. Why didn`t your client, the little 10th-grade girl, get to speak in court?

GLORIA ALLRED, ATTORNEY FOR VICTIM: Great question, Nancy. And I was there with her in court. The judge said that in New York state, the victim only has a right to give a victim impact statement if there is a felony that the defendant admits to. The district attorney, however, said that it`s discretionary -- in other words, that the court can allow the victim to speak and give a victim impact statement if it`s a misdemeanor. He pled to a misdemeanor. The court could have let her testify. She wanted to give a victim impact statement, but he wouldn`t let her give it. And that is wrong and that is why she gave it outside of the courtroom, not inside.

GRACE: You`re seeing right beside Gloria, her client, the 10th-grade girl. And Gloria is absolutely right about the law. The law says you have a right, as a victim of a felony, to speak in court. Nobody can take that away from you. But the law does not say if the crime was a misdemeanor, you`re banned from speaking. That was Judge William Kelly`s decision not to allow the girl to speak.

And now to Kathy, the sister of the rape victim in the Lawrence Taylor case. Kathy, thank you for being with us. Are you surprised at how lightly Lawrence Taylor got off on this thing?

KATHY, SISTER OF VICTIM: It was wrong for him to be lightly off. If he was a normal person and wasn`t rich, he wouldn`t have gotten off so lightly. Instead, they`re, like, Oh, he`s famous, he`s a Hall of Famer, so he just gets a slap on the wrist and gets to go home.

GRACE: And Jean Casarez, it`s not over yet. All he`s got to do is report once every three years to police. But he`s going to be on the road. Nobody is going to be supervising this sex predator.

CASAREZ: With possibly endorsements deals, as his attorney said today.

LAWRENCE TAYLOR: It`s one of those -- (INAUDIBLE) call it crimes -- one of those crimes that you never think about, that you never think you`re going to get -- you`re going to get busted because everybody does it.

GRACE: There`s no punishment! What punishment?

UNIDENTIFIED MALE: It`s more (ph).

GRACE: Everybody doesn`t do it! We are taking your calls live. Judge Kelly ordered not only straight probation for "Dancing With the Stars" phenom Lawrence Taylor, but put no restrictions on him from the bench, leaving it up, hopefully, to the probation department to take care of Taylor. He washed his hands of dealing with this sex offender.

We are taking your calls. Back to Deborah in Arizona. What`s the rest of your question, dear?

UNIDENTIFIED FEMALE: Why does he not have to register as a sex offender? And is it possible that he could have paid the judge off some money? I can`t believe the judge`s demeanor in all this, laughing at this case. This is unbelievable.

GRACE: I doubt -- I`ve heard nothing about a bribe of any type. But this is just indicative of the attitude toward professional sports, or toward TV stars. The judge -- what about it, Jean?

CASAREZ: Nancy, it started with the plea deal. He was charged with third degree felony rape. With that, I don`t think he`d get the lowest level sex offender...

GRACE: And Jean, what he`s doing is trying to push it off, hoping that Taylor will stay down in Florida, where he says he`s got a house, and pushing it off on the Florida probation department. That`s what the judge did.

CASAREZ: That`s right. But this is a man that travels for a living, so how long will he even be in the state of Florida?

UNIDENTIFIED FEMALE: Taylor agreed to plead guilty.

UNIDENTIFIED FEMALE: Guilty.

UNIDENTIFIED FEMALE: Nobody is holding Taylor accountable for having no sense of conscience.

GRACE: They should all be ashamed!

LYNETTE TAYLOR: He didn`t rape anyone.

UNIDENTIFIED FEMALE: She is and was a crime victim.

GRACE: We are taking your calls. Unleash the lawyers. Joining us tonight, Raymond Giudice, defense attorney, Atlanta, Randy Kessler, defense attorney, Atlanta. What about it, Ray Giudice? Couldn`t the judge have made some sort of effort to put an order, some kind of restriction on Lawrence Taylor?

RAYMOND GIUDICE, DEFENSE ATTORNEY: Look, there`s no question that from day one in every decision, this case has broken in Mr. Taylor`s benefit and in his favor. No question about it. The judge, every time he had the ability to exercise discretion, he`s exercised it in Taylor`s favor, including, as you just suggested, putting all kinds of restrictions on that six years probation because that can be done -- limiting alcohol use, limiting -- putting on a curfew, et cetera, et cetera. You`re absolutely right.

GRACE: Well, I can`t believe you`re saying that.

GIUDICE: Well...

GRACE: Everybody, you`re seeing Lawrence Taylor, video from ABC`s "Dancing With the Stars." But Ray, I happen to know not only are you a former prosecutor turned defense attorney, a big sports fan. Come on, Ray. Let me see Giudice! Couldn`t he say at least, Stay out of strip clubs?

GIUDICE: Yes.

GRACE: Couldn`t he at least say, No booze for you? This is after the attorney, the defense attorney, has the -- I`m not even going to say the word I`m thinking -- let me just say gall to ask the judge, can his client drink wine. He didn`t put any order whatsoever. In fact, his lawyer`s big concern is what kind of sponsorships, LT, Lawrence Taylor, is going to get when this is all over. That`s his concern, Ray! That is wrong!

GIUDICE: Well, you know, it`s not wrong for the defense lawyer to do that. That`s his job. It`s the prosecutor`s job to push back and it`s the judge`s job to use discretion. But let me just throw one...

GRACE: At least...

GIUDICE: ... thing out. A lot of people...

GRACE: Well, throw it in a hurry.

GIUDICE: One quick thing. Six years probation, any violation of the criminal law statute, I guarantee you this judge revokes probation, in jail for the balance of the sentence.

GRACE: Fat chance. Fat chance! Come on, Kessler, please don`t say anything like that because you know that`s not true. The judge is allowing him straight probation, didn`t even bother to say stay away from teenage girls, no more hookers. I mean, as if it`s not obvious he shouldn`t be with (INAUDIBLE) to start with, this is a guy with a six-hooker-a-day habit, Kessler!

RANDY KESSLER, DEFENSE ATTORNEY: Right, but this is not about someone who slept with hookers. This is not a punishment. You`re lumping all child predators together. He thought he was with a 19-year-old. That would be wrong...

GRACE: It doesn`t matter under the law what he thought!

KESSLER: So no matter...

GRACE: It could be a defense in every statutory rape case! She told me she was 21. She could be 11 years old, if that`s the truth (ph)!

GRACE: She shows up at the "Dancing With the Stars" celebrity hotel room --

GLORIA ALLRED, VICTIM`S RIGHTS ATTORNEY, CHILD ADVOCATE: A swollen eye. I think it was obvious that she had been battered.

UNIDENTIFIED FEMALE: Like they made it seem like he went up on a schoolyard and snatched some girl off with pigtails and dragged her back to his room and beat her --

GRACE: We are taking your calls. Back to a special guest joining us, the sister of the rape victim in the Lawrence Taylor case. Kathy is joining us.

Kathy, again, thank you for being with us. How is your sister responding to all of this?

KATHY, SISTER OF RAPE VICTIM IN LAWRENCE TAYLOR CASE: Well, at first she took it hard, you know. She was upset about it. She was angry. And she had every right to be and now she`s just like hanging in there, she seems strong. And I really have to give it to her, like even though she may be my little sister she makes me look up to her with the strength that she has.

GRACE: Has your sister told you what she went through that night?

KATHY: She told me everything and to be honest it broke my heart.

GRACE: What was the one thing that was the most disturbing to you, Kathy, about what your sister lived through?

KATHY: Most disturbing was that she had got bruises. And I saw the - - I saw the bruise on her face. And it really hurt. Like I cried. And then to be dragged off to be raped by some guy and then to have it denied?

GRACE: You know, I`m looking at your little sister on the screen right now, the judge didn`t even let her speak in the courtroom. There she is on the courthouse steps. There`s no way that that is a 19-year-old girl. Is there any way she could be mistaken for a 19-year-old woman?

KATHY: No way at all. She doesn`t -- there`s no way she can look like a 19-year-old girl even if she wanted to.

GRACE: What does she think about Lawrence Taylor?

KATHY: She said it was horrible. She feels disgusted. She can`t even look at him.

GRACE: Does she say she ever told him she did not want to go through with it?

KATHY: She told me she had no choice but to go through with it because she was afraid the pimp was at the door or that if she told Lawrence Taylor no that maybe he would call the pimp and the pimp would beat her even more.

GRACE: And you`re saying the bruises were evident.

KATHY: The bruises were there. It wasn`t even a small bruise. Nancy, it was a really big bruise. You`d have to be blind not to be able to see it.

GRACE: Well, I can tell you one thing, nobody in America wants to wake up and see Gloria Allred sitting on the other side of the courtroom looking at you with that look and that`s just what Lawrence Taylor is in for.

Gloria, I know you`re not going to comment.

Show me a picture of Lawrence Taylor`s house, the big one.

What`s concerning me, David Lohr, is this guy travels all over America professionally. Nobody is going to be supervising him and the judge hasn`t even bothered to put a single restriction on him.

Let`s me see that house. There you go. Take a good look, Gloria.

OK, David Lohr, what do you think about that?

DAVID LOHR, CRIME REPORTER, AOLNEWS.COM: Well, this whole case is disgusting, Nancy. I mean every single aspect of it from the sentence he has got to the fact that he`s not shown one iota of remorse for the victim in the case and --

GRACE: Put Lohr up. Put -- look at those palm trees.

Hey, Lohr, a 52-year-old man paying a pimp for a tenth grade girl. Here`s a guy who openly admits on "60 Minutes" he used six hookers a day, and thousands in cocaine and here`s this judge saying, you know, I just don`t think he`s going to offend again.

Help me, Lohr. Throw me a bone.

LOHR: Well, it`s disgusting. You know every aspect of it and you know what`s disturbing to me is the type of person he apparently is because if you look now at a case he`s got coming up here in April, where the mother of his daughter is asking for additional child support, because their kid is suffering from Crohn`s disease, a debilitating disease, he apparently doesn`t have the money to cough up more money for his daughter but he can go out and spend $300 a night on hookers. So go figure.

GRACE: Well, according to him, Lohr, he was using six hookers a day. I don`t know how much he was paying them, but I`ll tell you what. This one girl, this tenth grade girl, is going to cost him a whole lot more than $300 if Gloria Allred has anything to do with it.

What is the message this judge is sending?

LAURA DUNN, RAPE SURVIVOR AND VICTIMS RIGHTS ADVOCATE: I mean, the message that the whole criminal justice system has sent to victims every where who are watching this is horrific. I mean it`s very clear this man has the ability to not have sexual relations with this poor victim.

She was abused and he didn`t even ask her if she was OK. And he went ahead and used her for his own purposes. And then the criminal justice on top of this violation is not giving any justice in this case. No jail time, no significant financial fine for all this.

It`s just disgraceful. And I think it`s sending the wrong message.

GRACE: To Stacy Kaiser, a psychotherapist, joining us out of L.A. And what about that wife who was all over the airwaves saying this didn`t happen, that girl went into that room asking for money, he just did her a favor.

STACY KAISER, PSYCHOTHERAPIST: I mean I really can`t believe she did that as a woman and knowing that her husband did what he did. However, here`s what I tell you.

I see this with a lot of wives of athletes. They like the lifestyle, they like the money. They are afraid of upsetting who they`re married to. And so they`re pretty much willing to say anything to keep their marriage alive.

GRACE: To Barbara in New York. Hi, Barbara. What`s your question, dear?

BARBARA, CALLER FROM NEW YORK: Hello, Nancy angel and hello, Jean.

I think this is sick. The judicial system failed this young lady miserably. So I`m praying that Gloria with her fierceness can get chunks and chunks of money and make it right at least in that respect.

But this is my question. He`s a level one sex offender. He can go to his son`s school and whatever else he can do there. But I want to know, is there anything the school can do about this, or parents of children that are in that school who are very uncomfortable with this whole mess?

He`s a piece of garbage and his wife should be ashamed of herself. And thank you for taking my call.

GRACE: First of all, thank you for calling in, Barbara in New York. But now that the judge has ruled, there`s really nothing that the parents of school children can do about it. All we can do is hope that when he is in Florida he will fall under Florida statutes regarding child sex predators.

Even though the judge didn`t order it, maybe Florida will do something about it.

What about it, Jean? What could Florida do?

JEAN CASAREZ, LEGAL CORRESPONDENT, "IN SESSION": Well, Florida could make him appear before a probation officer regularly scheduled time. They can put him on the registered sex offender registry so that residents and schools and churches will be notified when he is around where he may live currently.

GRACE: Florida is going to be lot tougher on him. But my question is -- let`s go to the lawyers, Raymond Giudice and Randy Kessler.

Raymond, when he`s outside the jurisdiction of Florida, how will this apply to him? You got a New York judge ordering basically nothing, nothing at all. He probably got Lawrence Taylor`s autograph, as Lawrence Taylor was leaving the courtroom.

So how is this guy to apply when this guy is on the road?

RAY GIUDICE, DEFENSE ATTORNEY: You hit the nail on the head. You have to have a Florida probation officer try to determine if he commits a violation in Las Vegas that would violate a New York probation case. And without an ankle monitor that`s going to pick up drugs or alcohol, without a curfew, without a GPS, unless he is arrested or somebody brings like a photograph evidence to that probation department of him committing some violation of probation, it`s probably not going to happen, Nancy.

RANDY KESSLER, DEFENSE ATTORNEY: Yes, but he`s Lawrence Taylor. I mean he`s Lawrence Taylor. People are going to see him. He`s going to be noticed. It used to be good to be Lawrence Taylor.

GRACE: OK. Kessler, Kessler, Kessler. He`s had six hookers a day and thousands in cocaine a day, and nobody said anything? So thanks for the thought.

Very quickly to tonight`s case alert. Cops track down a couple wanted for robbing a chain of lemonade stands raising money for 2-year-old Logan Varnadoe, born with only one-third of his brain.

Twenty-year-old -- just see their picture again. Twenty-year-old Gage Turner and 21-year-old Amber Umbarger, pull up, grab the jar from the three little girls and take off with $130 lemonade money.

UNIDENTIFIED REPORTER: Just in, take a look at this. New surveillance video surfaces, allegedly of 35-year-old lifetime convicted sex offender Matthew Mallory and his 14-year-old niece. Police extremely concerned for her safety.

UNIDENTIFIED REPORTER: The U.S. Marshal`s Office is confirming this surveillance video is of Matthew Mark Mallory and his niece Ariel Mallory. U.S. Marshalls have also released this video the two at a Walgreens on East Houston Street.

UNIDENTIFIED MALE: He basically is controlling her actions and her movement right now.

UNIDENTIFIED REPORTER: U.S. Marshal`s Office and Lone Star Fugitive Task Force were immediately brought in and dozens of men began to search by land and air.

UNIDENTIFIED REPORTER: Authorities say Mallory has a history of sexually molesting minors. Police tracked Mallory and his niece to the San Antonio area.

UNIDENTIFIED REPORTER: Authorities believe he is also armed with a .22 rifle and a .380 handgun. Now authorities tell me they are also paying close attention to any burglary or stolen vehicle calls in the area because one of those could lead to Mallory and his niece.

Joe, how did this guy, a sex offender, get the girl?

JOE GOMEZ, REPORTER, KTRH RADIO: Nancy, it is a horrific tale. I mean this 14-year-old beautiful Angel Ariel has absconded with her 35-year- old uncle who police describe as a violent rapist, a level three sex offender who has been convicted of sexually assaulting children in the past.

This search has been going on for about a week. Investigators have been combing through a wooded area near San Antonio after discovering an abandoned camp site presumably belonging to the two. Also spotting the two at a Walgreens and at a local Wal-Mart, Nancy.

Every moment that goes by this beautiful 14-year-old little girl`s life is in danger. This man is a violent rapist, convicted of rape several times. He`s been convicted of sexually assaulting children.

GRACE: Jean?

CASAREZ: U.S. Marshal`s Office is saying this man is armed and dangerous. This all started in Oklahoma.

GRACE: Hold up. Just hold up. Jean. Jean.

We are receiving breaking news. We are hearing that the sex offender has been apprehended. He has been apprehended. We know that he showed up at a Walgreens and a Wal-Mart. The marshals there in San Antonio, Texas, pulled out all the stops. They found out he was at a Walgreen, that he was headed to a Wal-Mart. They go to the Wal-Mart.

They follow up on everything. They find stolen tags on the car and somehow trace it back -- they backpedal. They`ve got Matthew Mallory with them.

To Deputy U.S. Marshall Tom Smith, Lone Star Fugitive Task Force with the U.S. Marshal`s Office.

Deputy, thank you for being with us. Where were they apprehend and is the girl OK?

DEPUTY U.S. MARSHAL TOM SMITH, LONE STAR FUGITIVE TASK FORCE, U.S. MARSHAL`S OFFICE: Yes, the main thing is the girl is OK. She`s a little dehydrated. And they were caught just south of San Antonio within three or four miles of where we -- where the abandoned car was.

GRACE: With us, special guest, Deputy U.S. Marshal Tom Smith.

We are learning the sex predator has been apprehended and the girl is alive.

Deputy Smith, how did you guys catch him in?

SMITH: Well, this worked out really good because the media kept this alive. A rancher was out feeding his stock and he saw them behind a trailer changing clothes. Now they didn`t see him and he immediately called his brother-in-law who is a Bear County deputy sheriff and reported it, and the Sheriff`s Office responded, our folks responded.

The sheriff`s deputies got there fairly quickly, snuck up on him, tackled him and got him in handcuffs. End of story.

GRACE: You know, Deputy Smith -- everyone, Deputy U.S. Marshal Tom Smith joining us out of San Antonio, Texas, with the Lone Star Fugitive Task Force.

Deputy Smith, this is what I couldn`t understand. This is a 14-year- old girl taken by a 35-year-old level-three, lifetime convicted sex offender. And the mother apparently had this guy living in the home with her little girl.

I`ve also learned the little girl just had a baby. This little 14- year-old girl had a baby, the baby is already several months old. This means she gave birth when she was either 12 or 13.

I wonder whose baby that is, Deputy Smith.

SMITH: I don`t know, but I`m sure that DNA will determine whose baby that is and if it happens to be Matthew`s, then I hope he gets what he deserves.

GRACE: You know what? Unfortunately under our jurisprudence system we don`t have the death penalty for child rape.

With me is Andrew J. Scott, former chief of police, Boca Raton, president, AJS Consulting.

What`s with the mother? I blame her, too. Why does she have this guy under her roof with her little girl? Somebody gets the little girl pregnant, she gives birth at 12 or 13 years old. And now --

ANDREW J. SCOTT, FMR. CHIEF OF POLICE, BOCA RATON, FL.; PRESIDENT, AJS CONSULTING: You know, Nancy --

GRACE: And now this sex predator runs off with her and kidnaps her?

SCOTT: You know this is the issue that we fine all across the country, Nancy, where we have parents who really don`t care very much for their children, allow these men to come in to their homes, invade their homes, so to speak, and really are powerless and let these individuals, these sick individuals such as this individual, to control the household.

And I`ve got to be honest with you, I would hope that the investigation into how this all came to pass would eventually wind up to be an arrest for the mother because frankly it would not have happened had the mother stepped in.

GRACE: To Dr. Bill Manion, medical examiner, Burlington County, joining us out of Philly.

Dr. Manion, how do you tell who the baby`s father is? How quickly can we determine that?

DR. BILL MANION, MEDICAL EXAMINER, BURLINGTON COUNTY, NJ: Probably in a matter of days. They can get swab from the baby, from the punitive father, Mr. Mallory, and they`ll be able to do a DNA test. And come up with a pretty good answer I think in a matter of days.

GRACE: What this child has lived through, Jean Casarez. Tell me how it went down. I want to see the video, the surveillance video. San Antonio, Texas, marshals got a hold of it. And that was all she wrote, apparently. There you go.

CASAREZ: You know it`s amazing. It started in Oklahoma. They thought that the vehicle might be going to Missouri, but officials in San Antonio, Texas, located a car under a bridge with the keys still in the ignition. It was Florida plates but they traced the number to Mallory in Oklahoma and that`s how it came down in San Antonio. And that`s how this little girl was found.

GRACE: So thanks to some San Antonio, Texas, law enforcement this little girl is safe. And there`s no telling how traumatized she is or what she`s been through. She`s now only just 14 years old.

Deputy Smith, I`m really surprised that she`s alive.

SMITH: You know, we were so relieved when we retrieved that video from Walgreens and Wal-Mart because obviously that was our biggest concern was the health and welfare of this young girl. So everybody breathed a sigh of relief that was involved in this case from here to Oklahoma. So that was -- we are very happy to find her alive.

GRACE: Unleash the lawyers. Raymond Giudice and Randy Kessler.

First of all to you, Kessler, what is a convicted sex offender doing living with a 13 -- a 12-year-old, non-blood relative? Explain that to me.

KESSLER: You know if I could explain that, I`d be a genius. I`m obviously not a genius. There`s no way in the world he should have been. And that mother should lose custody and she should be penalized to the full system.

GRACE: What about it, Giudice? Can she be charged with child endangerment?

GIUDICE: I think she could. As a level-three sex offender compared to Mr. Taylor who`s a level one from the first story, he had no contact with non-family member children.

GRACE: We are taking your calls. We have just learned this little girl, a 14-year-old girl, kidnapped by a 35-year-old convicted lifetime sex offender, has just been caught. Thanks to not only Oklahoma authorities, but San Antonio police.

GRACE: Gomez, spit it out, for Pete`s sake.

GOMEZ: Sorry. Sorry, Nancy.

GRACE: What?

GOMEZ: The girl`s uncle -- the girl`s uncle`s brother married the girl`s mother. There you go. And basically that`s how that works out. And then in n the past apparently the uncle and the mother also had some kind of relationship, Nancy. So very strange love triangle there.

GRACE: All I can say to you, Deputy U.S. Marshal Tom Smith, Lone Star Fugitive Task Force, is thank you. And may this guy, Matthew Mallory, rot in hell.
