NANCY GRACE

Ft. Myers Family Found Shot to Death; Paris Caught in Lie About Cocaine Purse

Aired September 2, 2010 - 20:00:00   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

NANCY GRACE, HOST: Breaking news tonight, live, Vegas. Midnight, a motorcycle cop pulls up to an intersection to waves of marijuana. It`s none other than Paris Hilton, reeking of pot! It gets worse. In her pocketbook, cocaine. Defense, Paris Hilton says, A, it`s not her purse, and B, she thought the drugs were gum. Yes, chewing gum. She says she thought cocaine was chewing gum. And of course, even being a repeat offender, Paris Hilton walks free.

Bombshell tonight. While prosecutors stand by waiting for a trial date, deciding just how they`re going to handle Paris Hilton, Vegas take action now. Tonight, Paris Hilton formally banned from the most luxurious hotels in Vegas. And torpedo to the state! In a stunning legal twist, we learn Paris Hilton never given a blood test the night of the arrest! Will a legal loophole keep Hilton out of prison?

But also tonight, just uncovered, after Hilton insists the purse she carries the night she`s busted is not hers, we discover just before her late night arrest, Hilton tweets a photo of herself carrying her brand-new sparkling Chanel bag. It`s a photo ID match to the one stashing (ph) cocaine right in front of police. Vegas prosecutors, hello? It`s cocaine! What`s the hold-up?

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: (INAUDIBLE) walked the front entrance to the detention facility like she was walking a catwalk!

PARIS HILTON, CELEBRITY: Thank you.

UNIDENTIFIED FEMALE: She really hasn`t changed her lifestyle that much.

HILTON: I`ve always remained the same person I was since I was a little girl.

UNIDENTIFIED FEMALE: (INAUDIBLE) pristine (ph) form (ph). There was a spring in her step.

HILTON: I think it`s just about staying true to yourself and not letting all this get to your head.

UNIDENTIFIED FEMALE: ... banned from the Wynn Hotel in Vegas. She was at the hotel when police say they found cocaine that fell out of her purse.

HILTON: I can`t live without my BlackBerry.

UNIDENTIFIED FEMALE: ... paparazzi princess Paris Hilton...

HILTON: ... my boyfriend...

UNIDENTIFIED MALE: She was arrested...

HILTON: ... my pets...

UNIDENTIFIED FEMALE: ... cocaine .8 grams...

HILTON: ... my family and...

UNIDENTIFIED FEMALE: It looks like a glamour shot.

HILTON: ... and my best friends...

UNIDENTIFIED FEMALE: She`s got numerous mug shots.

HILTON: I`m going to do the time. I`m going to do it the right way.

UNIDENTIFIED FEMALE: With her arrest for alleged cocaine possession...

HILTON: And I thought it was the next perfect thing for my brand.

(END VIDEO CLIP)

GRACE: And tonight, live, Ohio. Paramedics race to an Akron apartment after a bone-chilling 911 call about a 23-month-old baby girl`s bathtime accident. The pregnant baby-sitter leaves to go get a towel, then thud, she finds the baby limp, vomiting profusely, she says. Drowning in a nearly empty tub? We confirm the baby had bleeding to the skull plus advanced brain swelling. Does that sound like drowning to you? Not me!

Then there is the seemingly frantic 911 call. We have the 911 audio. Breaking tonight, as we go to air, a secret grand jury hands down a murder charge. And in the last hours, pregnant baby-sitter breaks down in court. I say you should break down!

(BEGIN VIDEO CLIP)

911 OPERATOR: What is your emergency?

UNIDENTIFIED FEMALE: I really didn`t mean for -- I didn`t mean for her to fall! Please get a paramedic here now!

GRACE: Her story to police is that...

UNIDENTIFIED MALE: She went to the closet to retrieve something.

UNIDENTIFIED MALE: I was going to get a towel! A towel!

UNIDENTIFIED MALE: She heard some noises.

UNIDENTIFIED MALE: She heard a thud.

UNIDENTIFIED MALE: She heard several thumps.

UNIDENTIFIED MALE: And when she returned, she found the child unresponsive in the bathtub.

GRACE: Her story makes no sense.

UNIDENTIFIED MALE: Oh, my God! (INAUDIBLE) She is puking. Please help me!

UNIDENTIFIED FEMALE: Police say she struck or shook the little girl.

UNIDENTIFIED MALE: ... shaken baby syndrome...

UNIDENTIFIED FEMALE: I was just trying to lay my daughter down...

GRACE: I hear her on the 911 call say, I was trying to get my little girl to lay down.

UNIDENTIFIED FEMALE: Her breathing`s starting to act weird! Her breathing`s starting to act weird!

UNIDENTIFIED MALE: There is bleeding on the surface of the skull.

GRACE: She is a liar! Why is she lying?

UNIDENTIFIED FEMALE: If this kid dies in my arms, I cannot live with that!

UNIDENTIFIED MALE: The brain hits the inside of the skull...

UNIDENTIFIED MALE: Now the baby-sitting is sitting in the county jail, charged with murder.

UNIDENTIFIED MALE: You understand that charge?

UNIDENTIFIED FEMALE: Yes.

(END VIDEO CLIP)

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight, while Vegas prosecutors stand by waiting for a trial date, deciding just how to handle Paris Hilton, Vegas takes action now.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Paris Hilton may have been banned from the Wynn Hotel in Vegas. That`s according to "People" magazine.

HILTON: I`m just so excited.

UNIDENTIFIED FEMALE: She was at the hotel when police say they found cocaine that fell out of her purse.

UNIDENTIFIED FEMALE: ... busted on suspicion of felony cocaine possession...

HILTON: I`m really (INAUDIBLE)

UNIDENTIFIED MALE: Poor little rich party girl!

UNIDENTIFIED FEMALE: Police say that Hilton told them that the purse was not hers.

HILTON: Oh, we weren`t there. I don`t know what happened with that.

UNIDENTIFIED FEMALE: Tests confirm it was, indeed, cocaine, .8 grams.

HILTON: I hope that (INAUDIBLE)

UNIDENTIFIED FEMALE: Paris Hilton will learn when she has to learn.

HILTON: I just don`t pay attention to any of the nonsense that`s around in the town.

UNIDENTIFIED FEMALE: Paris Hilton is due to appear before a judge in late October.

HILTON: The media portrays me in a way that I`m not.

UNIDENTIFIED FEMALE: She tweeted this. The stories that have been out there, she says, they`re cruel and ridiculous and she is ignoring them.

(END VIDEO CLIP)

GRACE: But first, live to Ft. Myers area, just coming in now. Police report an entire family believed to have been shot inside the family home. Traffic now blocked off, police cordoning the area as the investigation is in its initial stages.

We go live now out to Anjuli Lohn, reporter with CNN affiliate WINK. Anjuli, thank you for being with us. What can you tell us, Anjuli?

ANJULI LOHN, WINK CORRESPONDENT: Of course. Well, it`s a truly tragic scene. Lake (ph) County sheriff`s office is confirming two adults and one infant child are dead inside a home that you can see just behind this yellow "caution" tape in this Lehigh Acres neighborhood.

Now, well over a dozen deputies swarmed the area earlier this afternoon after they received a call from someone who walked in to find the three people dead inside the home. Investigators are releasing very few details, but here`s what we do know. They are treating this as a double murder/suicide investigation. Now, this stretch of the Eastlake (ph) Drive neighborhood in Lehigh Acres continues to be shut down as investigators look for answers to this truly tragic story. We`ll bring more information as it becomes available.

GRACE: With us, Anjuli Lohn, joining us from CNN affiliate WINK. Anjuli, any idea about what actually happened in the home? Everyone, Anjuli Lohn reporting three dead, at least, inside this Ft. Myers area home. Go ahead, Anjuli.

LOHN: Now, we talked to some neighbors, and the sheriff`s office is not confirming any of this information, but we have heard that this is a fairly normal family, a pretty young family. But they are saying -- neighbors are telling us that there were domestic violence issues in the past.

GRACE: Also with us, in addition to Anjuli Lohn, joining us there in Lehigh Acres, Florida, is Hugh Nolan, investigative reporter also joining us out of Florida. Hugh, what more can you tell me?

HUGH NOLAN, INVESTIGATIVE REPORTER (via telephone): There`s not much that can be added. This is a brand-new and developing situation. Police arrived on the scene at only about 4:00 PM, immediately following that call from the individual who had walked into the home and discovered the bodies. They`re not making any details available until they`ve completed notification of family members. The only thing we do know at this point is that we do have three dead, apparently two adults, one young child. And the neighbors have said that living in that home, the family in that home, two adults, one young child.

GRACE: Back to Anjuli Lohn with WINK. Anjuli, I know this happened in the last couple of hours. And you`re saying someone walked into the home and just came upon the dead bodies?

LOHN: That`s right. They`re not releasing who that person is. Apparently, they walked in around 4:05 and immediately called the sheriff`s office as soon as they discovered a truly tragic scene.

GRACE: Anjuli Lohn, it seems like a pretty quiet neighborhood, a residential area, tree-lined streets. What can you tell us about what was going on inside the home?

LOHN: I mean, we talked to some of the neighbors here. They`re telling us that -- I mean, they`re completely shocked by this. Again, they said that they saw, you know, the family walking down the street with their child, never would have expected something like this happening here in Lehigh Acres.

GRACE: Everyone, we will update you throughout the evening as we get more. As of right now, we know there in Lehigh Acres -- it`s just outside of Ft. Myers, Florida -- three dead inside a single-family dwelling. It`s a residential area, a really nice area, tree-lined streets. The neighbors don`t know of any prior disturbances, and we do not know who the trigger person is right now. We do believe all three have been shot. We will take you back to Lehigh Acres as more information comes in.

But right now, to Vegas.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: She was actually offered a ride in a limousine for the rest of the night. The promoter of the party where she was said, Paris, we can give you a limo. She said, No, no, it`s OK. My boyfriend can drive. So she leaves the party. The two of them are going down Las Vegas Boulevard. The cop pulled up next to them and could smell the marijuana.

When the police pulled them over, she immediately actually tried to roll up the window, which they found very suspicious, maybe trying to hide what was in the car. So as the police asked -- started asking questions, a huge crowd starting forming around Paris because it was right on Las Vegas Boulevard. So she says to the cops that she`s a little embarrassed.

(END VIDEO CLIP)

GRACE: Joining me right now, Mike Walker, senior editor, "National Enquirer," joining us out of LA. Mike Walker, it never ends. While prosecutors in Vegas are trying to figure out just how to handle Paris Hilton, Vegas acts now, tonight, banning her from some of the most luxurious hotels on the Strip. What happened, Mike?

MIKE WALKER, "NATIONAL ENQUIRER": Well, here`s the good news, first of all, Nancy. Even though she`s barred from the Wynn Hotel, the Hilton Hotel has just issued a statement saying that Paris is always welcome at their hotels. Isn`t that great?

GRACE: OK, and what exactly is the connection? Where is she related to a Hilton?

WALKER: Well -- well, her grandfather, of course, was the founder of the Hilton hotel chain.

GRACE: Grandfather.

WALKER: The whole family fortune is based on that. But...

GRACE: I didn`t know how far back it went, Mike Walker. But you know, forget about that. I want to talk about now. The Wynn Hotel has booted her. What else do you know, Mike Walker?

WALKER: Well, I know this, Nancy. David Roger (ph) -- remember him? He`s the man who put O.J. Simpson behind bars, not even for murder, for 19 to 35 years for that little armed robbery situation he had. Las Vegas is not Los Angeles. They can get tough. And David Roger is now facing an election. And you know district attorneys facing an election. High- profile case like this, I don`t think he`s going to plea bargain. I think he`s going to be a little tough on her.

GRACE: Well, another thing, Mike Walker -- Mike Walker, senior editor, "National Enquirer," has had many, many stories regarding Paris Hilton. It`s not just that it`s high profile it`s that it`s Vegas. And they don`t want the reputation out there that they`re Crime City. They don`t need that!

WALKER: That`s right, they don`t, although you wonder whatever happened to the old saying "What happens in Vegas stays in Vegas." This has certainly blown up. And Paris is putting herself in trouble by saying all these -- tweeting all these things about how it`s ridiculous and cruel and these are all rumors. This is the wrong way to approach this. They`re going to not like Paris in Las Vegas.

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Paris Hilton has a court date.

HILTON: It`s paying off right now (INAUDIBLE)

UNIDENTIFIED FEMALE: Could this girl get anymore foolish?

HILTON: I`m happy.

UNIDENTIFIED FEMALE: ... busted on suspicion of felony cocaine possession.

HILTON: I can`t wait to start (INAUDIBLE)

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Paris Hilton busted for cocaine...

UNIDENTIFIED FEMALE: ... banned from the Wynn Hotel in Vegas...

HILTON: I`m happy to be a part of it.

UNIDENTIFIED FEMALE: She was riding in her boyfriend`s car. They were on the Vegas Strip.

HILTON: I`m really scared, but I`m ready to do this.

UNIDENTIFIED FEMALE: A policeman pulled up next to the car that Paris was in and smelled what he suspected to be marijuana smoke coming from their car.

UNIDENTIFIED FEMALE: She tweeted this. The stories that have been out there, she says, are cruel and ridiculous and she is ignoring them.

UNIDENTIFIED MALE: The 29-year-old claims that the small amount of cocaine is not hers.

UNIDENTIFIED FEMALE: It was at the hotel when police say they found cocaine that fell out of her purse.

HILTON: I have a lot of other projects in the works, so I`m glad.

UNIDENTIFIED FEMALE: She said, Yes, the cash, the credit cards, the Albuterol in the purse were hers, but not the coke.

HILTON: I hope that I`m an example to other young people when they make decisions.

(END VIDEO CLIP)

GRACE: Straight out to Mary Margaret, senior news editor with Radaronline. Also joining us, Mike Walker, senior editor, "National Enquirer." Mary Margaret, I understand that she`s saying that this is not her purse. I`ve got the two pictures of where she -- please put it up, Liz. No, no, no, no, no. Not that one, the one that she tweeted. There you go.

Now, I can`t imagine somebody actually tweeting this, but, "Love my new Chanel purse I got today." All right, there it is. Just -- Mary Margaret, how much does something like that cost?

MARY MARGARET, RADARONLINE.COM: It costs thousands of dollars. And obviously, it`s not one of a kind. It is plausible that one of her other wealthy friends had it and she...

GRACE: Wait a minute!

MARGARET: ... you know, wanted to match it...

GRACE: Wait a minute, Mary Margaret!

MARGARET: ... to her dress.

GRACE: As beautiful and intelligent as you are, I want to look at the pocketbook. You`re looking at something that`s probably as expensive as a car. You could buy a car for what she paid for this Chanel purse.

MARGARET: I know.

GRACE: And she`s saying, Mary Margaret, that the pocketbook with the cocaine stashed in it was not hers. And this is the pocketbook. She tweeted about it a couple of weeks ago.

MARGARET: Yes, I mean, it`s definitely a hole in her story. Not only did she tweet about it, she was spotted several times over the summer wearing it on red carpets, wearing it to events. It`s a very distinguishable purse. She`s obviously someone who`s photographed wherever she goes, and there`s a long trail of photo evidence with her wearing the purse.

GRACE: And let me remind everybody her defense is, A, it`s not her purse, and B, she thought it was gum.

OK, unleash the lawyers. We are taking your calls live. With us, Eleanor Odom, felony prosecutor, death-penalty qualified, joining us out of Atlanta, John Burris, defense attorney joining us out of San Francisco, and Peter Odom, defense attorney joining us out of Atlanta.

But first, Danny Bonaduce, talk show host, 94.1 WYSP. Danny, it`s a pleasure to meet you over the airwaves. I grew up watching you as a child star.

DANNY BONADUCE, RADIO TALK SHOW HOST: Thank you.

GRACE: Now you are clean, cold sober. Do addicts just lie about everything? You know. You were there. Do they just lie about everything, even their Chanel purse?

BONADUCE: Boy, do I hate to say this. It`s an honor to be here. And yes, we do. Yes. Of course, we lie about everything. Even though I haven`t taken an illegal drug in over 20 years, it was hard to break the habit of lying. You just get used to it. And the fact that she doesn`t even cover her lies, that she even didn`t remember the tweet with the pictures of the purse, just shows she`s become numb to her own -- the amusement of lying just for the sheer pleasure of it.

And the thing is, she`s accomplished something quite -- I find Paris Hilton to be trivial, but now she`s accomplished something almost unheard of. She`s banned from the Las Vegas Strip. The only other person I can think of that accomplished that is Bugsy Siegel, and he had to get shot through the eye to do it! So this is fairly impressive that she was able to do this. With the defense that, I thought it was gum -- it`s called "blow," but try and blow a bubble with it!

GRACE: With me, Danny Bonaduce. You all remember him growing up as a child star.

Back to the lawyers. OK, Eleanor, just like Bonaduce just said, you just lie so much, it`s just like second nature. You even don`t realize you`re doing it. We have photos of her showing the pocketbook that had the cocaine in it. And now she`s formally committed herself on the record, saying, That`s not my pocketbook.

ELEANOR ODOM, PROSECUTOR: I love that, Nancy, because it`s such a good piece of evidence for the state. And how many times I have heard a defendant say, Oh, not my jacket, not my pants?

(CROSSTALK)

GRACE: ... not my car, not my jacket, not my pants, not my cocaine, not my pot!

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: Paris Hilton has gotten away with a lot.

UNIDENTIFIED FEMALE: ... preferential treatment for her name...

UNIDENTIFIED MALE: Over and over and over she does things.

UNIDENTIFIED MALE: Good luck, Paris!

UNIDENTIFIED MALE: ... her antics. And you know, she`s broken the law quite a bit, and she`s always kind of gotten away with it.

(END VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED MALE: ... busted in Vegas...

UNIDENTIFIED FEMALE: A cop pulled them over. Paris`s boyfriend failed sobriety tests.

HILTON: (INAUDIBLE) something that (INAUDIBLE)

UNIDENTIFIED FEMALE: Paris requested a trip to the restroom.

UNIDENTIFIED MALE: ... alleged possession of cocaine...

UNIDENTIFIED FEMALE: According to the police report, the officer told Paris to leave her purse on a table. She said then that she needed lip balm.

UNIDENTIFIED FEMALE: Police say that Hilton told them that the purse was not hers.

UNIDENTIFIED FEMALE: As she reached for that lip balm, a packet of powder fell out of the purse.

UNIDENTIFIED FEMALE: This is the third time that Paris has been busted this year in some sort of drug-related activity.

(END VIDEO CLIP)

GRACE: We`ve got an all-star lineup for you tonight to break it down, put it back together again. It`s not just about Paris Hilton, it`s about cocaine and it is about a two-tiered justice system, rich man`s justice versus the rest of us. While prosecutors in Vegas try to figure out exactly what to do with Paris Hilton, Vegas acts tonight, banning her from the most luxurious hotels on the strip. And as Bonaduce just pointed out, only one person has succeeded to do that in the past. That was Bugsy Siegel.

Back to Mike Walker before I go back to the lawyers. Mike, what do you think about the fact that she is now saying -- even though your publication, "The Enquirer," has numerous pictures of her holding this pocketbook -- and now she`s outright lied. She`s caught red-faced, red- handed lying. And they can bring this in at trial!

WALKER: Yes, they should. And it`s such an obvious and egregious lie. I wonder what her attorneys -- how they`re going to handle this. First of all, Nancy, you know as a prosecutor that, It wasn`t my purse...

GRACE: Oh!

WALKER: ... it wasn`t my pants -- -

GRACE: Wait! Mike, Mike, Mike, Mike! Take a look at your monitor. What`s that white stuff on Paris Hilton`s nose?

(LAUGHTER)

WALKER: The white stuff on Paris Hilton`s nose, according to her publicist at the time, a man that I know, Eliot Mintz (ph), a very eloquent man -- he said, Oh, he said, she doesn`t do narcotics. That`s probably, like, a little bit of dessert that she got through her nose. He said, I would call it a stray dessert.

GRACE: OK...

WALKER: That`s the guy you want as a PR guy.

GRACE: I see you chuckling. I don`t think it`s funny. Go ahead about the pocketbook.

WALKER: Well, the pocketbook -- what everybody doesn`t mention -- you know, everybody`s talking about, Oh, there were credit cards and cash and all of that. There were also Zigzag papers in there. That`s used to roll marijuana cigarettes. This is her third run-in with the law in a month over drugs. The idea that this young woman doesn`t do narcotics is ludicrous. She says she wants to be a role model for young girls? Yes, for Lindsay Lohan maybe!

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Can you tell me what you`re wearing tonight?

HILTON: Esteban Cortizon (ph).

UNIDENTIFIED FEMALE: And why (INAUDIBLE)

HILTON: Because I love it. This is Julia McDonald (ph), a British designer. I love it. I`ve been wearing it for years.

UNIDENTIFIED FEMALE: Paris Hilton could be trading in her Prada or Gucci for some jailhouse duds pretty soon, and they`re definitely not designer.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED REPORTER: Paris Hilton walked to the front entrance of the detention facility like she was walking a catwalk.

PARIS HILTON, HOTEL HEIRESS: Thank you.

UNIDENTIFIED REPORTER: She really hasn`t changed her lifestyle that much.

HILTON: I`ve always remained the same person as I was when I was a little girl.

UNIDENTIFIED REPORTER: Perfect posture, pristine form. There was a spring in her set.

HILTON: It is just about staying true to yourself and not letting all this get to your head.

UNIDENTIFIED REPORTER: Banned from the Wynn Hotel in Vegas. She was at the hotel when police say they found cocaine.

(END OF VIDEO CLIP)

NANCY GRACE, HOST: We are taking your calls. Out to Diane in Washington. Hi, Diane.

DIANE, CALLER FROM WASHINGTON: Hi, Nancy. It`s nice to talk to you again.

GRACE: Likewise.

DIANE: Your twins are adorable and you are an inspiration to all women and the like, I think. And I appreciate everything you do.

My question is -- well, I kind of ended up having two. But one thing is, why did they not do a blood check? And the second one is, why are they paying these people like Paris Hilton to come to these hotels and just sit there?

Isn`t that giving them more of a reason to party? Isn`t that adding fuel to the fire?

GRACE: Good question. Let`s take the first one. Unleash the lawyer, Eleanor Odom, John Burris, San Francisco, Peter Odom, Atlanta.

To you, Eleanor Odom, I think they should have taken the blood test. They didn`t. I don`t find that fatal to a possession of cocaine charge, though.

ELEANOR ODOM, PROSECUTOR: No, in fact, it shows that you are, in fact, possessing cocaine if you test positive with it in your system. That`s a no-brainer.

GRACE: But there thing is here, John Burris, they did not do the blood test. That was a boo-boo. So they`re not going to be able to prove conclusively that she possessed or had -- was using pot, marijuana. But they don`t need a blood test to show there was cocaine in her pocketbook.

JOHN BURRIS, DEFENSE ATTORNEY: No, that`s true. They don`t. It just raises the question of, does she had knowledge of it. But certainly blood test would have been --

GRACE: Wait, put Burris up.

BURRIS: You know, I don`t know if -- I don`t know if they could have made her take a blood test anyway at that point in time. She wasn`t obligated to take one. She wasn`t driving a car. So I don`t know if they could have made her do that in time enough to make -- they would have had to get a search warrant for it to occur.

GRACE: Uh-uh. Uh-uh. She was in a vehicle and they suspected marijuana --

BURRIS: No, she wasn`t driving, though. She wasn`t driving.

GRACE: But she was in the vehicle. Marijuana is still a crime, Burris.

BURRIS: No. Marijuana is a crime. But that only means that a crime is taking place in the car that someone has done it. But they can`t make her take a blood test because they have no right to do that without a search warrant. Just because she`s in the car, that doesn`t give them a basis to do -- take a blood test. There`s got to be a warrant.

GRACE: I assume you`ve heard of the exigent circumstances exception to the warrant.

BURRIS: Obviously I`ve heard of exigent circumstances.

GRACE: Eleanor, come in.

BURRIS: But I don`t think. I would say that doesn`t apply to the situation.

E. ODOM: Well, yes, you could in it. And it wouldn`t be that hard to get a search warrant anyway because that would stay in your blood system --

BURRIS: Well, you`ve got to do it.

E. ODOM: -- a long time.

GRACE: So what about it, Peter Odom?

PETER ODOM, DEFENSE ATTORNEY: They had no basis to ask her to take a blood test. They could not have done it, they would not have gotten a search warrant in time to show any evidence.

And John is exactly right. Now it would have helped their case on possession had they done that. But she would have had to do it voluntarily. No basis for a search warrant.

GRACE: Eleanor, do you believe that when cops smell you reeking of pot you can`t be arrested for the use of pot? And -- and have a blood test and then when they see cocaine in your pocketbook, I don`t see any reason they could not have gotten a blood test.

E. ODOM: They could have gotten a blood test. They probably could have gotten a search warrant. But they had probably cause to get that search warrant.

GRACE: Agree. Agree. And there are cops -- excuse me, judges and magistrates on call 24/7, 365 in Vegas. Don`t worry about that.

I want to go to the question from Diane of Washington about why they didn`t take it.

Andrew Scott, former chief of police, Boca Raton, president, AJS Consulting, Miami. Why not take the blood test? I understand why they didn`t. I wish they had. But why didn`t they?

ANDREW J. SCOTT, FMR. CHIEF OF POLICE, BOCA RATON, FL.; PRESIDENT, AJS CONSULTING: Well, out in Las Vegas there`s probably one of the elements of the crime is not having to show or requiring the blood to be tested to prove possession. And so I think that`s part of an element of a crime that`s missing in this particular issue.

The other thing, the attorney is correct. She wasn`t driving. She was a passenger. And then you go into these issues of probable cause of why you`re going to take blood which is a very significant search of an individual even though you have probable cause that she may have been smoking marijuana and/or ingesting cocaine.

GRACE: To Dr. Bethany Marshall, psychoanalyst and author of "Dealbreakers." Even though she`s not welcome anymore, officially banned from multiple hotels there on the Vegas Strip, the elite hotels like the Wynn -- why do other hotels still pay her up to $100,000 for a single appearance to party in their lounge?

BETHANY MARSHALL, PSYCHOANALYST, AUTHOR OF "DEALBREAKERS": Because they are more concerned about their pocketbook and drawing in customers who will order drinks and order rooms and fund money into the hotels than they are about a potential substance abuser.

And the fact that she`s displaying all the characteristic signs of a substance abuser -- denial, a sense of victimization, lack of insight into potential negative consequences. It`s just really egregious on the part of the hotels.

GRACE: Back to Mike Walker. Mike, senior editor of "National Enquirer." And for those of you out who say I don`t read the tabs. I got one word for you, right.

OK, Mike, why would a bar pay Paris Hilton $100,000 a hit to come and drink at their venue? Why?

MIKE WALKER, SENIOR EDITOR, NATIONAL ENQUIRER: Because we`re obsessed with celebrity now. The obsession -- and I have been covering this field for many years -- even staggers me how we are obsessed with celebrity.

Yes, you can pay people. We heard the other day from paparazzi saying that you tell Lindsay Lohan to go back to her -- Paris, not Lindsay. You know you could call up and say, we need you down here for a picture. We`ll give you a 10 grand. She`ll be there in five seconds.

All of these people make money by showing up places. And Paris Hilton, what is so annoying is that people worship her and they forget things like she had in her petition to Governor Schwarzenegger of California asking for pardon after her felony.

She said in her petition that she should be forgiven because, quote, Nancy, "she brings beauty and excitement into our otherwise mundane lives." We`re the peasants.

GRACE: Repeat. Repeat, Mike Walker. What did you just say?

WALKER: I said that she said to Governor Schwarzenegger in her petition, asking for a pardon, to wipe out, you know, the thing about her driving with a suspended license on probation.

She said in her petition that she should be pardoned partly because she, quote, Nancy, "brings beauty and excitement into our otherwise mundane lives." In other words, we`re the peasants. She is the princess.

And unfortunately, a lot of people buy into this. They will go to these hotels. Her boyfriend, I bet, is disappointed. He thought he was doing his job bringing her into that hotel.

Steve Wynn, of course, has promptly fired him from his job as manager of both hotels. The Wynn and the Encore. The -- not manager. The hotel of the clubs.

GRACE: To Mary Margaret, senior news editor, RadarOnline.com. Didn`t she just kind of go under -- for a period of time try to stay under the radar, out of our sights so we would forget about her last run-in with the law? Now the minute she comes back she gets arrested for cocaine?

MARY MARGARET, SR. NEWS EDITOR, RADARONLINE.COM: We do know and sources have told us that she was under advisement to lay low. Every where she goes she seems to not be able to stay out of trouble. Even though she says that the cocaine may not have been hers, you know, there`s that adage, you know, you are the company that you keep.

So there`s definitely this sort of cloud of controversy that seems to follow her wherever she goes.

GRACE: You know, Mary Margaret, I don`t know where you come from, but in my neck of the woods it`s you lay down with the dog, you wake up with a flea. All right?

Out to the lines, Elizabeth in Texas. Hi, Elizabeth.

ELIZABETH, CALLER FROM TEXAS: Hi.

GRACE: Hi, dear. What is your question?

ELIZABETH: first of all, me and my mom love you so much. You and your twins. And I want to say she was caught with the cocaine in her possession. Why wasn`t she charged with it?

GRACE: She has just been charged. That was my initial thought, too, Elizabeth in Texas. And I was about to blast the prosecutors.

But out to Mary Margaret. There are actual charges now, cocaine charges, correct?

MARGARET: Yes. There are charges. A lot of it was, you know, just in due process and making sure that, you know, the officials verified every single step of the way, but she has been charged.

GRACE: To Danny Bonaduce, as I was telling him in a break, he`s not a Partridge anymore but a lot of us grew up singing the theme song and watching him. And now he is the poster person for recovery.

DANNY BONADUCE, ACTOR, "THE PARTRIDGE FAMILY": Well, thank you.

GRACE: Danny Bonaduce, David Roger, the prosecutor, is not going to let this thing go and he shouldn`t let it go.

BONADUCE: No. He can`t let it.

GRACE: Why?

BONADUCE: He absolutely can`t let it go because it`s now open season where -- it goes in waves. There was a time when you could keep a Hollywood secret. The studios ran -- remember when everybody was shock that Rock Hudson turned out to be gay?

GRACE: Danny. Danny. Other -- other than that, it`s wrong to let it go.

BONADUCE: Absolutely. But the DA will not let it go. Would you want to be the judge or the DA that did not put Paris Hilton in jail this time? She`s going to jail.

(BEGIN VIDEO CLIP)

UNIDENTIFIED REPORTER: She is in (inaudible). She was on this long vacation all summer. She`s detained at a private airport because drug- sniffing dogs allegedly detected marijuana in her purses. She`s question for about 30 minutes. Let go. No charges filed in that incident either.

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED REPORTER: Paris Hilton may have been banned from the Wynn Hotel in Vegas. That is according to "People" magazine.

HILTON: This is so exciting.

UNIDENTIFIED REPORTER: She was at the hotel when police say they found cocaine that fell out of her purse.

UNIDENTIFIED REPORTER: Busted on suspicion of felony cocaine possession.

HILTON: I`m really (INAUDIBLE) and I`m ready to do it.

UNIDENTIFIED REPORTER: Poor little rich party girl --

UNIDENTIFIED REPORTER: The police say that Hilton told them that the purse was not hers.

HILTON: We weren`t there. I don`t know what happened with that.

UNIDENTIFIED REPORTER: Tests confirmed it was indeed cocaine, 0.8 grams.

HILTON: I hope THAT I`m an example to young people.

UNIDENTIFIED REPORTER: Paris Hilton will learn when she has to learn.

HILTON: I just don`t pay attention anyway to the nonsense just around in this town.

UNIDENTIFIED REPORTER: Paris Hilton is due to appear before a judge in late October.

HILTON: The media portrays me in a way that I`m not.

UNIDENTIFIED REPORTER: She tweeted this, that the stories that have been out there she says were cruel and ridiculous and she is ignoring them.

GRACE: Out to the lines, Susan in Georgia. Hi, Susan.

SUSAN, CALLER FROM GEORGIA: Hi, Nancy. I`m a big fan. And I`m currently reading and enjoying your "11th Victim."

GRACE: Thank you very much. I hope you haven`t figured out who done it. OK, what`s your question?

SUSAN: I haven`t yet. From the moment we heard that Paris was in a rush to go to the bathroom and needed her lip balm, my daughter and I both looked at each other at the same time said she was pulling out the lip balm only to get the cocaine and flush it on her trip to the bathroom.

She knew what she was doing. I wonder if she still had to go to the bathroom after she dropped the cocaine.

GRACE: Good question. What about it, Eleanor? I have to say I thought the same thing as Susan did when she tells the cops on the street, oh, I`m embarrassed. Embarrassed of what? When has she ever been embarrassed in front of a camera?

Yes, no, Mike Walker? Hasn`t she had shots taken of her without any underwear at all?

WALKER: Yes, she has. And the lady had a very good point. Paris -- there have been reports that Paris is adept at hiding certain things inside her body if you will. So I think the lady is absolutely right.

GRACE: OK, you know what? Don`t make my mind go there, OK. Please, don`t. OK.

Eleanor, obviously, Susan is right. Especially with the -- let me just say illumination Mike Walker has just given us. She was going into that bathroom. When was she ever embarrassed in front of a camera? She said, oh, I`m embarrassed, I`ve got to go in.

Now I`ve got to go to the bathroom. Then she goes, then she goes, oh now, I`ve got to get some lip balm. Lip balm? My booty. Who needs lip balm when they`re about to be arrested?

So, then she goes into the pocketbook and oops, out comes the cocaine.

E. ODOM: And Nancy, again, that`s the oldest trick of the book with these defendants where they`re trying to get rid of the evidence as your caller suggested and they`re trying to cover it up, and do whatever they can with it very quickly. Again, she is no stranger to this.

GRACE: To Dr. Gwenn O`Keefe, pediatrician, founder and CEO of PediatricsNow.com. Joining us out of Boston.

Dr. Gwenn, welcome. Dr. Gwenn, in your history of dealing with so many different incidents, different patients, what is your history with cocaine addicts? They just don`t even understand what they`re doing anymore?

DR. GWENN O`KEEFE, M.D., PEDIATRICIAN, FOUNDER & CEO, PEDIATRICSNOW.COM: Nancy, they are sneaky. I have had people come into the ER where you can tell they are buzzing around the room, just energized beyond belief, and they will feed you a load of all sorts of stuff to either get another drug or to just try to con you.

I mean they are just -- just the way the other experts have described. They are -- they are really elaborate con artists. And they will try to hit you in your office. They will try to hit you anywhere for a drug. They really can lie and be very quite deceptive.

GRACE: And I know that`s hard on you because you`re trying your best to treat them appropriately. And typically you have to listen to every word a patient says and rely on it. But when they are a cocaine addict, forget about it, right?

O`KEEFE: That`s absolutely right. You try to find that window in where you can get them to sit down long enough to try to get them help and at least admit they have a problem. It`s really hard with cocaine. They don`t see it. They think the problem is you and they often get very belligerent.

GRACE: Everybody, we are switching gears. Taking your calls but now we are taking you to the story out of Akron, Ohio, of the pregnant babysitter turned killer.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: I was giving my daughter -- my friend`s daughter a bath and I walked out the room to grab a towel and she fell. And I don`t know. When I came back in there and she`s all limp.

UNIDENTIFIED MALE: She shook baby Alliyah.

UNIDENTIFIED 911 DISPATCHER: Is she conscious?

UNIDENTIFIED FEMALE: I -- no. No. Her eyes are going all --

UNIDENTIFIED REPORTER: Alliyah had advanced swelling to the brain.

UNIDENTIFIED MALE: Severe swelling.

UNIDENTIFIED MALE: Clearly this child is was a victim of shaken baby syndrome.

UNIDENTIFIED FEMALE: My god, dude, her eyes are different directions.

UNIDENTIFIED 911 DISPATCHER: What`s --

UNIDENTIFIED FEMALE: Please help me.

GRACE: That whole 911 call is BS.

UNIDENTIFIED FEMALE: I just need a paramedic. Please help me. I just want this kid to be -- oh my god, I feel so, so bad. Oh, honey.

UNIDENTIFIED 911 DISPATCHER: OK.

UNIDENTIFIED MALE: Staged this whole story about the bathtub and water and going to get towels.

(END OF VIDEO CLIP)

GRACE: She changed her stories so many times. Phil Trexler, reporter, "Akron Beacon Journal." What happened?

PHIL TREXLER, REPORTER, AKRON BEACH JOURNAL: Well, today, Nancy, the Summit County grand jury returned a four-count indictment against Tiffani Calise, alleging child endangering, murder and involuntary manslaughter.

We`ve also learned today that the records with the Summit Medical Examiner`s Office confirms what sources told us a couple of weeks ago that this child here apparently suffered or at least showing signs of suffering from injuries related to shaken baby syndrome.

For now Calise remains in the Summit County jail in lieu of a $500,000 cash bond and she`s due in court next week on Wednesday to be arraigned.

GRACE: With us Phil Trexler with the "Akron Beacon Journal." The 911 call is bone chilling. In her 911 call she contradicts her own story she gives police.

Matt Zarrell, explain.

MATT ZARRELL, NANCY GRACE STAFFER, COVERING STORY: Yes, initially she told police that she had walked away for just a second to get a towel, comes back and the baby is on the ground.

However, during the call she talks about the -- her 3-year-old daughter getting involved. And when the baby was brought to the hospital sources say he had significant brain injury suggesting that the injuries occurred well before 911 was actually called.

The hospital immediately called cops. Said she`s got bleeding on the brain. Cops began investigating and arrested her.

GRACE: And to Phil Trexler, why was the baby in her care to start with? And how many months pregnant is the babysitter?

TREXLER: The babysitter is about 10 weeks pregnant. And she`s friends with the baby`s mother. And this was a playdate that was arranged between Calise`s daughter and the victim.

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: She`s acting weird, she`s breathing weird. Please get a paramedic here now. Please, if this kid dies in my arms, I cannot live with that. Please get someone here now.

(END OF VIDEO CLIP)

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

UNIDENTIFIED FEMALE: Oh, my god. It`s puking again.

UNIDENTIFIED 911 DISPATCHER: Open her airways.

UNIDENTIFIED FEMALE: OK. I think she`s coming back because she`s pulling back. No, she stopped.

UNIDENTIFIED 911 DISPATCHER: Is she starting to vomit again?

UNIDENTIFIED FEMALE: No. Alliyah? Alliyah? Why can`t she hear me, ma`am?

UNIDENTIFIED 911 DISPATCHER: OK. Listen.

UNIDENTIFIED FEMALE: Did she hit her head that hard?

(END OF VIDEO CLIP)

GRACE: Out to the lines, Lynn in Virginia. Hi, Lynn.

LYNN, CALLER FROM VIRGINIA: Hi, Nancy. How are you?

GRACE: I`m good, dear. What`s your question?

LYNN: One thing I just wanted to tell you real quick is that you shoot straight from the hip. I admire that, whether people want to hear it or not, you tell them like it is. But my question is --

GRACE: Thank you.

LYNN: If you`re calling 911, I would think you`re going to give them facts and information, everything you can do to help. Well, during this 911 call she says previous this girl changed her story twice. First, it was to go get a tower for child said -- or for the child and then to go to her child down for a nap.

I think this girl`s tears were sincere. I think she was overwhelmed. I think she was just totally beside herself. But you know what? I think it was for herself.

GRACE: I think she was beside herself, Lynn. I think she was distraught. And like you said, I think it was all about herself. Because you hear her praying. And she goes, oh, god, help me, help me, help me.

Forget about the baby. And remember, Phil Trexler, wasn`t this phone call at almost midnight? Oh, I`ve lost Phil Trexler.

Matt Zarrell, when did she call 911? I`m not hearing anybody. The call --

ZARRELL: 11:40 p.m. she called 911.

GRACE: 11:40 p.m. So that child had been injured with a blow to the head long before that 911 call.
