Mother of King Brothers Speaks Out

Aired November 14, 2002 - 15:23   ET

THIS IS A RUSH TRANSCRIPT. THIS COPY MAY NOT BE IN ITS FINAL FORM AND MAY BE UPDATED.

MARTIN SAVIDGE, CNN ANCHOR: We're taking you to Pensacola, Florida.
This is Kelly Marino. She's the mother of the two young boys that entered guilty pleas for the murder of their father in a mediated settlement. She's speaking now.

(JOINED IN PROGRESS)

KELLY MARINO, MOTHER OF DEREK AND ALEX KING: And none of us were allowed to have a say in that.

All we wanted today was for it to be put out off until other things could be decided on or talked about or explored. I was told about this mediation by a reporter. I was not informed that we were going to be here, when it was going to be. You know, my children are -- they're smart and intelligent, but they don't know about life. They have no wisdom. They can't make this judgment for themselves.

That's like saying someone's 13-year-old can go off and decide for themselves they're going to go live with somebody else or go run to Disney World for the weekend or something. This is not right. This is America. And -- I'm done.

QUESTION: (OFF-MIKE)

MARINO: We have lots of options. And, yes, we do plan to challenge this.

QUESTION: (OFF-MIKE)

UNIDENTIFIED MALE: Well, she wants to continue on trying to protect her children. But we think, based on the way the plea was done, that they do have -- she does have a right to attack it as being intelligent and voluntarily entered, because they did not understand all their legal rights. And she also was not allowed to be present at the sentencing, and just a lot of procedural safeguards that were not provided for.

MARINO: My children were told...

SAVIDGE: And, again, you've been listening to Kelly Marino. She is the mother of the two young boys. That is Derek and Alex King, ages 14 and 13 respective. They have just entered mediated pleas to third-degree murder, entering guilty.

We're going to listen some more to her. MARINO: Well, what my children probably heard was: "You're going to get out of this cell here. You're going get to go out with other kids and play. And you're going to get to run out in the sunshine and all this. And it's going to be fun."

That's what they were looking forward to there, because they've been in a cell. They were told, if they plea to this, that they get to go have fun with other kids and everything else. They don't know the seriousness of this. That's all they're thinking about and considering.

UNIDENTIFIED MALE: It's also our understanding that the youthful offender...

SAVIDGE: Under the agreement that was reached, mediated in court just a short while ago, Derek, the 14-year-old, will get eight years, up to eight years in state prison in Florida, and Alex will get seven years -- the mother obviously opposed to that mediated settlement. She had challenged the competency of the two young boys as the hearing got under way.

That is the news right now.
