Election 2000: Bush Campaign Spokesman Discusses Suspended Palm Beach County Recount

DARYN KAGAN, CNN ANCHOR: More news out of Florida now, this time South Florida, West Palm Beach, and our John Zarrella standing by.

John, good morning once again.

JOHN ZARRELLA, CNN CORRESPONDENT: Good morning, once again, Daryn.

Well as everybody knows, the recount here has been suspended, won't get picked up at least until tomorrow. Two differing opinions, one from the secretary of state's office, election commission, saying they didn't have the legal authority to do it; one from Attorney General Bob Butterworth who says they do have the legal authority to do it. Now they are going to go to court, the county, to get a judge to tell them what they should or should not do.

And I guess, Tucker Eskew, chief communications director, correct?

TUCKER ESKEW, BUSH CAMPAIGN SPOKESMAN: A spokesman for the Bush- Cheney.

ZARRELLA: And Tucker, what is your take on all of this, do they have the authority or not?

ESKEW: Well, the canvassing board indicated they would go for a declaratory judgment today. But in the matter of the attorney general's decision to issue this opinion it needs to be noted that the attorney general, himself, has indicated for many months, if not years, that matters like this, when it comes to getting a legal opinion, you should go to the secretary of state, or rather the supervisor of elections.

And in fact, if I may briefly read from the Florida attorney general's own Web page. It says that "When opinions will not be issued, questions arising under the Florida Election Code should be directed to the Division of Elections." So it's quite clear that, in practice, he does not get involved in matters like this.

ZARRELLA: Tucker, I guess the American people are sitting there and saying this has gotten really down to partisan politics, one side versus the other side, and no matter what happens, somebody is not going to be happy with what is going on here in Florida. ESKEW: We are a nation of laws, and if those laws are upheld and fairly enforced under due process provisions of the Constitution, the American people can have great confidence in this process.

ZARRELLA: Tucker, thank you so much. I know you have had a hectic schedule here, and it continues on, as we watch the legal wranglings back and forth here in Florida.
