Fate of Young Cuban Refugee Elian Gonzalez Remains in Limbo

KYRA PHILLIPS, CNN ANCHOR: Now for the latest from Miami -- the Miami home, rather, of Elian Gonzalez, we're joined by CNN's Susan Candiotti in Little Havana.

Hello, Susan.

SUSAN CANDIOTTI, CNN CORRESPONDENT: Hello, Kyra.

Well, as Brian Cabell pointed out, those who don't want Elian Gonzalez to go back to his father in Cuba hope that they have bought a bit additional time after that Friday night subpoena issued to the boy to testify before a congressional committee on February 10.

Now, a U.S. official familiar with the case tells CNN the subpoena, quote, "appears to have no impact on the ability of INS to carry out its deadline." A legal counsel is studying the issue, and an official comment is expected this week.

Also this week, we are officially expecting a response from U.S. Attorney General Janet Reno, not only to the subpoena but following a Friday night meeting she held with a Miami delegation led by two Miami-area mayors, who are opposed to the boy's return.

Now, attorneys representing the boy's interests are also looking for a ruling as early as Monday from a family court judge, Rosa Rodriguez. The attorneys have asked that judge to grant temporary custody to Elian's great-uncle, with whom he has been living.

The attorneys representing the boy feel as though that would give them some extra oomph, as it will, when they go into federal court this week trying to demand a political asylum hearing for the boy. Many legal experts say that that petition could be in trouble because of the INS's ruling that Elian's father has the sole legal authority to speak for his son on immigration issues.

So at this time, it appears highly questionable as to how the INS intends to meet its deadline this Friday to send the boy home.
